SUGAR POLICY FOR CY 1995-96



WHEREAS, Executive Order No. 18, dated 28 May 1986, vested the Sugar Regulatory Administration with the power "to establish and maintain a balanced relationship between sugar production and the requirements of sugar and to maintain such marketing conditions as will ensure stabilized prices at a level reasonably profitable to the producers and fair to consumers";

WHEREAS, in order to promote the effective merchandising of sugar and its by-products in the domestic and foreign markets, it will be necessary to allocate the 1995-96 sugar production to such quantities as to place those engaged in the sugar industry on a basis of economic viability;

NOW, THEREFORE, pursuant to the powers vested in the Sugar Regulatory Administration (SRA), it is hereby declared that:

SECTION 1. Production and Classes of Sugar - Sugar production for the Crop Year 1995-96 (September 1, 1995 to August 31, 1996) is estimated at 1,900,000 metric tons and shall be quedanned by the mill companies, as implementors of this Sugar Order, in the following percentage:

"B" Domestic sugar ........................ 100.00%

SECTION 2. (a) As a general rule, except as hereinafter provided, sugar and molasses production for the CY1995-96 shall be issued by mill companies weekly sugar quedan-permits/molasses storage certificates in the name of the individual planter or mill company.

(b) In the cases, however, where a planter has expressly authorized the mill company in writing or has executed a production/marketing agreement in favor of his association/cooperative which agreement provides for the consolidation of his weekly sugar/molasses production in the name of the association/cooperative, the mill company concerned shall issue consolidated weekly sugar quedan-permits/molasses storage certificates in the name of the association/cooperative with an attached listing of the planters and their corresponding production covered by said sugar quedan-permits/molasses storage certificates.

SECTION 3. Periodic Assessments, Percentage Adjustments - The SRA shall undertake periodic assessments of the 1995-1996 sugar production and on the basis of such assessments, it shall adjust from time to time the percentage distribution of the different classes of sugar.

SECTION 4. Unshipped 1994-95 "A" Sugar - Unshipped 1994-95 "A" sugar is hereby granted priority in the filling of the 1995-96 U.S. Sugar Quota.

SECTION 5. Priority for Sugar Exporters - The SRA shall determine which Application for Shipment of "A" Sugar submitted by sugar traders/exporters shall be granted clearance for shipment of sugar during any period in accordance with the following: (a) priority under Section 4 of SRA Sugar Order No. 6, dated 23 June 1992, and (b) priority on a first-come, first-served basis and should there be more sugar at hand to fill the Quota at any given period, any excess sugar over said Quota shall be spilled-over to the next succeeding quarter provided, however, that should this happen in the last quarter, any excess sugar shall be prorated by the SRA and provided, further, that the tonnage of a vessel shall be determined by the SRA.

SECTION 6. Use of 1994-95 Quedan-Permit Forms - Unused sugar quedan-permit forms of the Crop Year 1994-95 duly validated by the SRA may be allowed for the last time for revalidation for CY 1995-96 sugar production upon prior application by any mill company or sugar refinery. Beginning crop year 1996-1997 and thereafter, all unused sugar quedan-permits of the previous crop year will no longer be allowed for revalidation.

SECTION 7. Repealing Clause - All provisions of sugar orders, circular letters, rules and regulations inconsistent with or contrary to this Sugar Order are hereby amended, modified, or revoked accordingly.
