(NAR) VOL. 21 NO.3 JULY - SEPTEMBER 2010

[ PHILRACOM RESOLUTION NO. 27-10, August 26, 2010 ]

TWO YEAR OLD VICIOUS HORSES



WHEREAS, the PHILRACOM has the exclusive jurisdiction over the conduct and control of horseracing pursuant to P.D. No. 420;

WHEREAS, there were instances in the past where there are horses that refused to be saddled or become hostile during the parade or while they are being loaded or paraded;

WHEREAS, upon the recommendation of the Regulation and Licensing Division (RLD) of the PHILRACOM, two-year old horses who are vicious under these categories;

1. Refused to be saddled;
2. Refused to be mounted and is hostile during the parade;
3. Refused to be loaded within three (3) minutes;
4. Hostile while inside the gate.

    Shall be given a penalty of:

a. 1st offense - written warning
b. 2nd offense - one (1) barrier trial
c. 3rd offense - suspended indefinitely but not more than fifteen (15) days with one (1) barrier trial
d. 4th and succeeding offenses – PHILRACOM pleasure

WHEREAS, it was also recommended that the suspension be made non-appealable; NOW, THEREFORE, resolved, as it is hereby resolved by the PHILRACOM Board of Commissioners, that:

Two-year old horses who are vicious under these categories:

1. Refused to be saddled;
2. Refused to be mounted and is hostile during the parade;
3. Refused to be loaded within three (3) minutes;
4. Hostile while inside the gate.

Shall be given a penalty of:

a. 1st offense - written warning
b. 2nd offense - one (1) barrier trial
c. 3rd offense - suspended indefinitely but not more than fifteen (15) days with one (1) barrier trial
d. 4th and succeeding offenses – PHILRACOM pleasure

RESOLVED FURTHER, that the suspension be made non-appealable. RESOLVED FINALLY, that the copies of this Resolution be furnished the concerned entities and people for their proper guidance.
