[ PRC BOARD FOR CUSTOMS BROKERS RESOLUTION NO. 07, S. 2005, September 22, 2005 ]

ADMISSION OF HOLDERS OF BACHELOR OF SCIENCE IN BUSINESS ADMINISTRATION, MAJOR IN TARIFF AND CUSTOMS ADMINISTRATION TO THE LICENSURE EXAMINATION FOR CUSTOMS BROKERS UNTIL 2008



WHEREAS, Sec. 16 (b), Art. III of R.A. No. 9280, known as the “Customs Brokers Act of 2004”, states, to wit:

 

Sec. 16. Qualifications of Applicants for examinations. – In order to be admitted to the licensure examination for customs broker profession, a candidate shall, at the time of filing his/her application, establish to the satisfaction of the Board that:

(b) he/she is a holder of a Bachelor’s Degree in Customs Administration: Provided, That a holder of a Master’s degree in Customs Administration shall be allowed to qualify within five (5) years from the effectivity of this Act; and”

WHEREAS, holders of Bachelor of Science in Business Administration, Major in Tariff and Customs Administration would like to take the October 2005 Licensure Examination for Customs Brokers or the subsequent schedule, and the students taking the same course who are presently enrolled in second year, third year, and fourth year thereof would naturally intend to take it in 2006, 2007, and 2008, respectively.

WHEREAS, the afore-said degree has the same scope and contents as those of the Bachelor’s Degree in Customs Administration as required in Sec. 16 (b) aforequoted;

WHEREAS, it is just, equitable, and practicable that the holders of such degree should be accommodated in the licensure examination subject to certain conditions;

WHEREAS, R.A. No. 9280 has no transitory provisions on such academic qualification; and

WHEREAS, the Board is empowered to “Perform such other powers, functions and duties as may be necessary to effectively implement this Act” (Sec. 7 (j), Art. II of R.A. No. 9280);

NOW, THEREFORE, the Board resolves, as it is hereby resolved, to admit a holder of Bachelor of Science in Business Administration, major in Tariff and Customs Administration to the October 2005 Licensure Examination for Customs Brokers and to the schedules in 2006, 2007, and 2008; Provided, the same degree shall include the same subjects in the Bachelor’s Degree of Customs Administration; Provided, further, the holder of the foregoing degree shall not be allowed to sit in the 2009 and subsequent schedules.

This Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or any newspaper of general circulation in the Philippines.

Let copy hereof be furnished to the schools, colleges, or universities offering the concerned course.
