ANNOTATION OF LEGAL BASIS ON THE SURVEY PLANS IN CASE OF CHANGE OF NAME AND LOCATION OF LOTS



Instances occur where the name and location of lots in a survey plan under process change due to the creation, division, merger, abolition and alteration of political boundaries of Local Government Units (LGUs), and transfer of lots from one political unit to another.

In those instances, the common practice is, to change the name and location of lots n survey plans subject of verification and approval in the DENR Regional Offices without indicating therein the legal basis for such change.

The said practice resulted in a number of legal actions due to confusion in the identification of lots.

Henceforth, to minimize, if not totally avert the filing of legal actions arising from confusion m the identification of lots, the legal basis in case of change of name and location of lots be annotated on the survey plans.

In view hereof and for purposes of uniformity, the legal basis shall be indicated in the space provided for "Notes" at the bottom of the left corner. The legal basis such as Presidential Proclamation, Republic Act, Sanggunian Resolution Number, etc. must be specified, including its date of effectivity.
