AMENDING DEPARTMENT CIRCULAR NO. 95-08-007 INSTITUTING DEMAND SIDE MANAGEMENT BY ELECTRIC UTILITIES



WHEREAS, pursuant to the provisions of Section 5 (a) and (g) of Republic Act No. 7638 otherwise known as "The Department of Energy Act of 1992", the Department of Energy issued on 02 August 1995, Department Circular No. 95-08-007 instituting Demand Side Management by electric utilities;

WHEREAS, there is a need to amend and clarify Section 1 (Scope of Application) of Department Circular No. 95-08-007 for the accomplishment of the objectives of the said Department Circular.

NOW, THEREFORE, Section I of the DOE Department Circular No. 95-08-007 is hereby amended to read as follows:

"SECTION 1. Scope of Application - The Department directs all electric utilities to consider alternative methods of meeting future demand for electric service. An electric utility is enjoined, therefore, to develop and submit a demand side management plan periodically every two (2) years to the Energy Regulatory Board (ERB) for review and approval beginning on or before January 01, 1996 for National Power Corporation and Class A - Utilities (e.g., MERALCO, PEPOA Members), July 01, 1996 for Category A - Cooperatives, and January 01, 1997 - Lower than Category A - Cooperatives."

This Department Circular shall take effect fifteen (15) days after its complete publication in a newspaper of general circulation.
