AMENDMENT OF SECTION 5 OF CIRCULAR NO. 1, SERIES OF 1993



Pursuant to Letter of Instruction No. 1095, Series of 1980, and Chapter 2 Section 7 (4), Book IV of the 1987 Administrative Code, Section 5 of Circular No. 1, Series of 1993 otherwise known as Guidelines on the Grant of Special Export Authorization (SEA) and the Accreditation of SEA Exporter is hereby amended to read as follows:

"The applicant for accreditation and Special Export Authorization shall pay a non-refundable filing/processing fee of One Thousand Pesos (P1,000.00) upon official acceptance of its application. An accredited exporter and SEA grantee shall pay an annual fee of Three Thousand Pesos (P3,000.00) every coffee year."

This DAO shall take effect fifteen (15) days after its publication in two newspapers of general circulation in the Philippines.

Guidelines on the Grant of Special Export Authorization (SEA) and the Accreditation of Sea Exporter

Pursuant to Letter of Instruction No. 1095, Series of 1980, and Executive Order No. 133, Series of 1987, and for the purpose of increasing the coffee exports and foreign exchange earnings of the country, the following guidelines shall govern the grant of special authorization to export coffee and accreditation of SEA Exporter:

SECTION 1. Any exporter not listed in the roster of accredited exporters for the Coffee Year 1992-93 shall be granted a Special Export Authorization (SEA) allowing it to export coffee in any form to any ICO or non-ICO member countries. This exporter shall therefore be referred to as SEA Exporter. The SEA shall be granted upon compliance with the basic documentary requirements in support of its application with the International Coffee Organization Certifying Agency (ICOCA).

SECTION 2. The SEA shall be effective from Coffee year 1992-93 until such time that the quota remains suspended.

SECTION 3. The SEA Exporter referred to under Section 1 hereof shall be qualified to apply for accreditation as coffee exporter subject to the following conditions:

  1. That, it has cumulative coffee export of not less than 15 MT green coffee bean equivalent in a particular coffee year;

  2. That, it shall file its application for accreditation during the same coffee year when the minimum export requirement was complied with; and

  3. That the date the coffee exports are laden on board shall be the reference date in determining whether such shipment falls within the period covered.

SECTION 4. Accreditation of SEA Exporter shall follow the accreditation procedures prescribed in Annex A of Circular 1, Series of 1989.

SECTION 5. All applicants for accreditation shall pay a filing fee of P1,000.00 and accreditation fee of P1,000.00.

SECTION 6. This Department Circular shall take effect upon approval.
