ADOPTION AND ENFORCEMENT OF THE PHILIPPINE AGRICULTURAL ENGINEERING STANDARDS (PAES) VOLUME VIII, PART 2, SERIES OF 2011



Whereas, Articles 5, 6, and 7 Chapter 1, Title II of the Republic Act No. 7394 otherwise known as the Consumer Act of the Philippines identified standards development and enforcement as the responsibility of the following departments: the Department of Agriculture (DA) (for agricultural products); Department of Health (DOH) (for drugs, cosmetics, devices and substance); and the Department of Trade and Industry (DTI) (for other products not covered by the DA an DOH);

Whereas, Section 59 of Republic Act No. 8435, otherwise known as the Agriculture and Fisheries Modernization Act of 1997 (AFMA) provides that "the Department shall give priority to the development and promotion of appropriate agricultural machinery and other agricultural mechanization technologies to enhance agricultural mechanization in the countryside".

Whereas, DA Administrative Order No. 11 series of 2001, mandates the Agricultural Machinery Testing and Evaluation Center (AMTEC) in partnership with the National Agricultural and Fishery Council (NAFC), Philippine Society of Agricultural Engineers (PSAE) and other concerned agencies to develop and formulate official agriculture and fisheries machinery standards, to be known as the Philippine Standards for Agriculture and Fisheries, now known as PAES;

Whereas, the development and enforcement of agricultural engineering standards is vital and necessary in ensuring safety, functional efficiency and economic viability of agricultural and fishery machinery and other agricultural engineering projects of the DA;

Whereas, six (6) volumes of PAES containing standards for production and post production machinery, agricultural buildings and structures, engineering materials, and standards for earth, gravel, bituminous and concrete Farm to Market Roads (FMR) had already been developed and adopted by the DA thru AO No. 10, Series of 2000; AO No. 6, Series of 2001; AO No. 11, Series of 2002; AO No. 5, Series of 2004; AO No. 7, Series of 2005; AO No. 28, Series of 2009; respectively as well as by the Professional Regulation wmmission (PRC);

Whereas, twenty (20) additional standards which comprise the PAES Volume VIII, Part 2, Series of 2011 had already been developed. Like the first six (6) volumes, Volume VIII, part 2 is a product of a long and extensive technical review and approval process, circulation and public hearings conducted by the National Agricultural and Fishery Council (NAFC) thru its Agriculture and Fishery Mechanization Committee (AFMeC);

Now, Therefore, I, Proceso J. Alcala, Secretary of the Department of Agriculture, P rsuantto Section 3, paragraph 3, Chapter I, Title IV, Book IV of the EO 292 of 1987 and in view of the foregoing, do hereby order the following:
 
Section 1 -Adoption of PAES VIII, Part 2, Series of 2011 — the following agricultural engineering standards are hereby adopted as the Philippine Agricultural Engineering Standards (PAES) Volume VIII, Part 2, Series of 2011;

Section 2 — Enforcement of the PAES

a.  All concerned DAOSEC, services, bureaus, attached agencies, corporations, foreign-assisted project offices, and regional field units shall enforce the PAES Vol. VIII Part2, series of 2011, including those agricultural engineering standards previously adopted by the DA as an integral part in the planning, regulation, bidding and implementation of their agriculture and fishery machinery and other agricultural engineering projects;
b.  The PAES Vol. VIII Part 2, Series of 2011 shall serve as technical reference for all DA agricultural engineers in the signing and sealing of plans, designs, and technical specifications of DA agricultural machinery and other agricultural engineering projects;
c. All Regional Field Units, through their Agricultural Engineering Division, shall coordinate with the Local Government Units, State Colleges and Universities and the field offices of concerned national government agencies for the enforcement of PAES Volumes I, II, HI, IV, V, VI, VII and Vllll (Parts 1 and 2).

Section 3 — Repealing Clause — All DA Administrative Orders, Special Orders and issuances inconsistent with this Administrative Order are hereby repealed and/or modified accordingly.

Section 4 — Effectivity — This Administrative Order shall take effect fifteen (15) days after simultaneously filing with the National Administrative Register of the UP Law Center and publication in the Official Gazette.
