[ NTA MEMORANDUM, December 09, 2010 ]

AMENDMENTS TO THE NTA TRADING RULES AND REGULATIONS (TRR) ON FEES IMPOSED IN THE PROCESSING OF APPLICATION OF LICENSES/PERMITS, LIFTING OF SUSPENSION OF MEMORANDUM CIRCULAR NO. 001-2009 AND DEADLINE OF FILING OF APPLICATION



Pursuant to the powers vested upon the National Tobacco Administration (NTA) by Executive Order No. 245 and in accordance with Executive Order Nos. 159 and 197, which authorizes all government agencies to revise their fees to at least recover the actual cost of services rendered, the following are hereby adopted for the compliance of all concerned, to wit:

Section 1. The license fees as provided in Rule 1, Regulation III (for Trading Centers) is amended as follows:

Section 2. The license fees as provided in Rule 1 of Regulation VI (for Field Representative/Viajeros) is likewise amended, as follows:

Volume of deliveries/acceptances based from the immediately preceding Trading Season or in case of new applicant the rate shall be based on the estimated volume of production per submitted list of tobacco farmers Fees(PhP)

2,001 - 20,000 kg 2,400.00
20,001 - 40,000 kg 3,600.00
40,001 - 100,000 kg 5,400.00
100,001 - 250,000 kg 6,750.00

Section 3. Effective Trading Season 2011 the cost of Certificate of Purchase (COP) shall be PhP200.00, per booklet.

Section 4. The permit fees as provided in Rule 1, Regulation VIII (for Wholesale Tobacco Dealers) and Rule 1, Regulation IX (for Redrying Plants) are hereby amended, as follows:

Section 5. The conduct of orientation/seminar on the TRR as provided in Paragraph i), Rule 4, Regulation IV (Requirements Before Buying) shall now be made as a pre-requisite before issuance of the License/Permit, with an orientation fee of PhP200.00, per participant.

In this connection, a Certificate of Attendance shall be issued by the Regulation Department-Tobacco Leaf Regulation Division, to all applicants who have undergone the orientation/seminar, which shall be attached to the application.

Section 6. The following dates are hereby set as the deadlines in the filing of application of License/COA/Permit to Buy/Redry, to wit:

1. Virginia January 14, 2011
2. Burley  
 Region I and MindoroJanuary 14, 2011
 Region II February 11, 2011
3. Native  
 Regions I & II February 11, 2010

A surcharge of fifty percent (50%) of the Annual License/Permit shall be assessed for applications filed after the deadlines set.

Section 7. The suspension in the implementation of following provisions of Section 1 of Memorandum Circular No. 001-2009 is hereby lifted and shall be implemented effective Crop Year 2010-2011, to wit:

“Section 1. Rule 2 of Regulation III of the TRR is hereby amended to include the following additional requirements, to wit:

“Rule 2. Requirements To Support The Application For License To Buy Leaf Tobacco - An application (RD Form No. 1) for the issuance of a License to Buy leaf tobacco, shall be filed with the Branch Office where the TC is located, and the same shall be supported by the following:

i. List of NTA-registered tobacco farmers/cooperatives/ associations with whom he/she has entered into a Memorandum of Agreement (MA) and not otherwise contracted by any other NTA-licensed buyer/s, indicating the location and area planted, as well as, estimated yield/production (RD Form No. 6);

j. List of contracted WTDs where he/she will sell his/her leaf tobacco acceptances (RD Form No. 7);

k. List of contracted or independent FRs from whom he/she will buy leaf tobacco and estimated purchases, as well as, the list of NTA-registered tobacco farmers/ cooperatives/associations with whom the FRs had entered into an MA and not otherwise contracted by any other NTA-licensed buyer/s, indicating the location and area planted, as well as, estimated yield/production (RD Form No. 6).”

For the guidance and compliance of all concerned.

This Memorandum shall take effect immediately and supersedes/revokes all Memorandum Circulars/Memoranda which are inconsistent herewith.
