OFFICE OF THE SANGGUNIANG PANLUNGSOD

AN ORDINANCE REQUIRING ALL PUBLIC PRIVATE AND COMMERCIAL ESTABLISHMENTS IN SAN JUAN CITY TO PROVIDE ACCESSIBLE CLEAN, FUNCTIONAL AND WELL-MAINTAINED HAND WASHING AREAS AND TOILETS FOR THE USE OF THEIR PERSONNEL, CUSTOMERS, CLIENTS AND PATRONS AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF.

EXPLANATORY NOTE

Section 21 of Presidential Decree No. 856 entitled the Code of Sanitation of the Philippines stales that:

a. Adequate and clean toilet facilities for male and female customers and personnel shall be provided in properly located areas.

b. Toilet rooms shall not open directly into spaces where food is prepared, stored or served. Where such toilels exist, the doors shall be tight fitting and self-closing.

c. Adequate hand-washing the provision of adequate hand-washing facilities shall be provided within or adjacent to toilet room;

d.  Facilities shall include hot and cold running water, single-service paper or cold towel dispenser or drying device and soap or detergent.

Effective hand washing is one of Ihe best public health measures to prevent the spread of diseases since the most common mode of germ transportation and transfer is through the hands.

Hence, the requirement of having functional and accessible hand-washing stations inside and/or adjacent to well-maintained toilet, washroom or comfort rooms for everyday use must be strictly observed in rotation to their health, environment, sanitation and business permits compliance and renewal.

NOW THEREFORE, BE IT ORDAINED By the Sangguniang Panlungsod in a session duly assembled that:

SECTION 1. SCOPE OF APPLICATION. All public, private and commercial establishments, regardless of the nature of their business and undertaking, are required to provide accessible clean, functional, well-matntained hand washing areas and

SECTION 2. IMPLEMENTING AGENCIES.

a. City Health Office. The City Health Officer shall, upon effectivity of this Ordinance, ensure that all establishments under its area of jurisdiction implement the provision of this Ordinance. It shall also conduct regular and random inspection of hand washing areas and restrooms on a regular basis.
b. Task Force Disiplina. The Task Force Disiplina, in coordination with tho City Health Office shall facilitate the enforcement of this Ordinance.
c. Public Information Office. The Public Information Office shall assist in the effective information dissemination.

SECTION 3. PENAL PROVISION.

1. All public, private and commercial establishments in San Juan City who, upon inspection, do not comply with the the requirement of having accessible clean, functional and well-maintained hand washing areas and toilets for the use of their personnel, customers, clients and patrons shall meet the following penalties:
  1. For the first offense - a written warning shall be served.

  2. For the second offense - a fine of Three Tousand Pesos (P3,000.00) shall be imposed.

  3. For the third and subsequent offenses - a fine of Five Thousand Pesos (P5,000.00) shall be imposed.
SECTION 4. CITIZEN COMPLAINTS.

Any person may file a complaint before the Mayor's Office, City Health Office, Task Force Disiplina or the San Juan Police Station for denying access to or lack of access to hand washing and/or toilet facilities.

SECTION 5. REPORTORIAL REQUIREMENT. The City Health Office shall submit a report to the Office of the Mayor copy furnished to the Sangguniang Panlungsod, on the status of inspection and implementation of this Ordinance.

SECTION 6. REPEALING CLAUSE. All ordinances or resolutions inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

SECTION 7. EFFECTIVITY. This Ordinance shall take effect Thirty (30) days after its publication in at least three (3) newspapers of general circulation.
