AN ORDINANCE REQUIRING MAJOR BUSINESS ESTABLISHMENTS WITHIN THE TERRITORIAL JURISDICTION OF QUEZON CITY TO PROVIDE PARKING SPACE FOR BICYCLES, AND PROVIDING PENALTIES, FOR VIOLATION

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that "Every local government unit shall exercise powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare. Within their respective territorial jurisdictions, local government units shall ensure and support, among other things the preservation and enrichment of culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities., improve public morals, enhance economic; prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants;

WHEREAS, there are growing incidents of bicycle theft in several business establishments such as malls, supermarkets, and other similar establishments;

WHEREAS, bicycles have bean a staple of everyday life throughout City. They are the most frequently used method of transport for commuting to work, school, shops, and others. They also offer a degree of exercise to keep individuals healthy. Bicycles allow people to travel for leisure into the country, since bicycles are three times as energy efficient as walking and three to four times as fast;

WHEREAS, there are towns in some countries where bicycle culture has been an integral part of the landscape for generations, even without much official support;

WHEREAS, this ordinance aims to protect the rights to property of the people of Quezon City.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:

SECTION 1. Title. This ordinance shall be known as "The Bicycle Parking Ordinance"

SECTION 2. Scope end Coverage - This ordinance shall apply to major business establishments particularly malls, supermarkets, groceries, banks, restaurants and other similar establishments to provide parking spaces for bicycle,

SECTION 3. Definition of Terms.
(a) Major Business Establishment - refers to malls, supermarkets, groceries, banks, restaurants and other similar establishments;

(b) Bicycle Parking Areas - a space with metal railings in which the riding public can safely park and lock their bicycles.
SECTION 4. Regulation - All Major Business Establishments are hereby mandated to provide bicycle parking space within their respected establishments.

SECTION 5. Penalties - Any person found violating any provision of this ordinance shall be penalized by a fine of Three Thousand Pesos (P3,000.00) or imprisonment of not exceeding six (6) months, or both such fine and imprisonment at the discretion of the court.

Any major' business establishment found violating any provision of this ordinance shall be penalized by fine of Three Thousand Pesos (P3,000.00) and the president, general manager or such other officer in charged with the management of the business shall be liable thereof.

SECTION 6. Separability Clause - If, for any reason or reasons, any part or provision of this Code shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full form and effect.

SECTION 7. Repealing Clause - All existing ordinances and resolution, local executive orders, rule and regulations inconsistent with any of the provisions of this Ordinance is hereby repealed and/or modified accordingly.

SECTION 8. This ordinance shaft take Affect fifteen (15) days after its publication in a newspaper at general circulation.
