AN ORDINANCE REQUIRING THE FOOD SERVICE INDUSTRY WITHIN THE TERRITORIAL JURISDICTION OF QUEZON CITY TO INCLUDE HALF (1/2) CUP AND/ OR ORDER OF COOKED RICE IN ONE OF THEIR DEFAULT SERVINGS, PROVIDING PENALTY THEREOF AND FOR OTHER PURPOSES.

WHERAS, the International Rice Research Institute (IRRI) reported that the country wastes at least P23 Million worth of rice per day which translate to at least P 8 Billion Pesos a year, an amount sufficient to feed 4.3 million people;

WHEREAS, citing the data from the Food and Nutrition Research Institute under the Department of Science and Technology (DOST) disclose that each Filipino wastes an average of three (3) tablespoons or nine (9) grams of rice daily, which is equivalent to 3.3 kilos per year. Rice is wasted when too much is cooked and served, but is not consumed;

WHEREAS, IRRI started a campaign to raise awareness in order to prevent rice wastage "Eat Your Rice Right and Save Lives", which advocated reducing rice waste at the consumer level;

WHEREAS, the hundred tons of rice wasted each year, not just in the Philippines but in the whole world, need to be taken seriously, our social conscience will tell us that the rice we waste, can just be the very rice we need to feed the hungry and the undernourished;

WHEREAS, cognizant and supportive of the campaign to reduce rice wastage, Quezon City is very sincere in its efforts to explore viable means that would facilitate the attainment of the said advocacy;

WHEREAS, empirical evidence shows that the availability of half cup or half order of rice serving would minimize wastage especially within the food service industry;

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, enjoins every local government unit (LGU) to exercise powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:

Section 1. Short Title - This Ordinance shall be known as the "Half-Cup Rice Ordinance of2014."

Section 2. Definition of Terms - As used in this Ordinance, the following shall mean:
a).
Food Service Industry - refers to those businesses, institutions, and companies responsible for any meal prepared outside the home which includes, but not limited to restaurants; fast food chains; schools; catering operations; office and hospital cafeterias and food courts operating within the territorial jurisdiction of Quezon City.
 
b).
alHalf Cup and/or Order of Rice - refers to one-half of 158 grams/cup or roughly 80 grams per order.
 
c).
Default Serving - refers to the preset selection of food/meal combinations offered by food service providers which will always be followed except when altered (e.g. value meal, student meal, combo meal and economy meal) and the like.
Section 3. Coverage - All businesses, institutions, and companies responsible for any meal prepared outside the home which includes, but not limited to restaurants; fast food chains; schools and hospital eateries; food courts and catering business operating within the jurisdiction of Quezon City are hereby required to include in their default serving of rice set at exactly half that of one (1) cup and/or order of rice in their regular menu with price exactly half of that one (1) cup and/order of rice menu.

Section 4. Implementation - Upon its approval, the City Mayor, with recommendation from the City Health Officer shall issue appropriate rules and regulations to ensure the proper implementation of the provisions of this Ordinance.  Food Service providers shall post in their respective establishments the new default serving with its corresponding price tag.  A copy of said Ordinance with the following message "Eat Your Rice Right and Save Lives" shall likewise be posted in said establishments.

Section 5. Penalty — Any food service provider, enumerated in Section 3 hereof, found violating this Ordinance shall be penalized as follows:
a).
First Offense - Written warning/reprimand from the City's Business Permits and Licensing Office.
 
b)
Second Offense - Fine of One Thousand Pesos (P1,000.00), and
 
c).
Third Offense - Fine of Two Thousand Pesos (P2.000.00) and one (1) month suspension of license or permit to operate.
Section 6. Effectivity - This Ordinance shall take effect upon-its approval of the City Council.
