AN ORDINANCE MANDATING ALL PRIVATE AND PUBLIC SCHOOL TEACHING AND NON-TEACHING PERSONNEL TO UNDERGO RISK REDUCTION TRAINING, PURSUANT TO REPUBLIC ACT NO. 10121, OTHERWISE KNOWN AS THE PHILIPPINE DISASTER RISK REDUCTION MANAGEMENT ACT OF 2010.

WHEREAS, the 1987 Philippine Constitution mandates the State to protect and promote the right of the people to basic health services, and instill health consciousness among them;

WHEREAS, the recent enactment of Republic Act No. 10121, otherwise known as the Philippine Disaster Risk Reduction Management Act of 2010, recognizes the necessity of being prepared for the eventuality of any disaster, natural or man-made, in order to prevent or lessen its after-effects;

WHEREAS, after the occurrence of calamities like flashflood, earthquakes and even fire, some schools are occasionally used as evacuation centers after a disaster;

WHEREAS, this City has recently passed Ordinance No. SP-2112, S-2012 requiring every Barangay to organize a Barangay Emergency Response Team to address cases of immediate risk to life and health;

WHEREAS, the same training and seminars should be conducted to the faculty members of private and public, schools, since majority of the children and youth are likewise to be inside campuses during daytime, should any disaster or emergency occur;

WHEREAS, the parents of the abovementioned students will feel a lot safer knowing that when it comes to emergency situations, the faculty are properly trained to provide immediate patient care;

WHEREAS, alongside with the Barangay Emergency Response Team, the City Government can now count on the school faculty members to support the Quezon City Rescue Team, therefore broadening the City's Emergency Response Network, making it more efficient and responsive to the needs that may arise.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY, IN REGULAR SESSION ASSEMBLED:

SECTION 1. TITLE - This Ordinance shall be known as "An Ordinance mandating all private and public school teaching and non-teaching personnel to undergo risk reduction training, pursuant to Republic Act No. 10121, otherwise known as the Philippine Disaster Risk Reduction Management Act of 2010."

SECTION 2. BASIS - It is the policy of the City Government of Quezon City to be firmly committed to the protection and promotion of the health and safety of all its residents.

SECTION 3. All private and public teaching and non-teaching personnel shall undergo regular Risk Reduction Training.

SECTION 4. IMPLEMENTATION AND MONITORING - Upon approval of this Ordinance, the Department of Public Order and Safety (DPOS), through its Local Disaster Risk Reduction and Management Office, is hereby tasked to conduct safety training and seminars, and monitor the effective implementation of this Ordinance.

For this purpose, the DPOS shall prepare a report on the progress of the implementation of this Ordinance.

SECTION 5. All public and private schools are hereby given six (6) months from the date of its passage, to comply with this Ordinance.

SECTION 6. PENAL CLAUSE - Any establishment which violates the provisions of this Ordinance shall be imposed a fine not exceeding Five Thousand Pesos (P5,000.00) and the cancellation or revocation of its Business Permit.

If the offender is a corporation, partnership or association or other juridical party, the penalty shall be imposed upon its officer/s responsible for the violation, without prejudice to the cancellation or revocation of its Business Permit.

SECTION 7. SEPARABILITY CLAUSE - If any provision of this Ordinance is declared unconstitutional or invalid, the other provisions hereof which are not affected thereby shall remain in full force and effect.

SECTION 8. REPEALING CLAUSE - All previous ordinances, resolutions, local executive orders, rules end regulations, or any part thereof inconsistent herewith are hereby deemed repealed, modified or amended accordingly.

SECTION 9. EFFECTIVITY CLAUSE - This Ordinance shall take effect immediately upon its approval.
