AN ORDINANCE PROHIBITING ALL FORMS OF OBSTRUCTION IN ALL ROADS WITHIN THE PERIPHERY OR CIRCUMFERENCE OF GOVERNMENT AND PRIVATE HOSPITALS IN THE CITY OF MANILA, AND FOR OTHER PURPOSES

EXPLANATORY NOTE

Recently, the City of Manila passed its local version of the Risk Reduction and Management Council (RRMC), in response to calls for measures to address with dispatch emergency situations that may occur in the event of a major earthquake or typhoon.

This is also in preparation for what savants and the Metropolitan Manila Development Authority experts have lately claimed that the "Big One" could happen and will happen anytime given the dormancy of the major fault lines, including the Valley Fault that runs through Marikina City and other communities along the eastern coastline of Luzon.

For it is a scientific fact that seismological dormancy results in the build up of pressure on the tectonic plates. This is what we fear most; hence, the MMDA called for the formation of local RRMCs in the metro. It is encouraging that our city responded to this call.

If this happens, there could be a breakdown of law and order like what happened to poor Tacloban City. In such a case, our city better be on its feet, possessed with the ability to prevent mass hysteria and ensuing chaos.

Given the high density in population and the kind of landscape, which is highly urbanized, the havoc such a tremor could trigger would be unimaginable.

Skyscrapers will certainly become very vulnerable because the subterranean foundations of these structures are made of peat.

Our city was built on reclaimed grounds out of the delta that was formed at the mouth of the Pasig through the centuries. Proof of this observation are the estuaries which used to crisscross the landscape, all but a few today that remain have become miserably polluted.

One important component in the response mechanism is the ability of Manila based hospitals to accommodates many victims who are expected to suffer physical and mental trauma.

Therefore, and to ensure that the functions and operations of our hospitals will not be hampered, their vicinities must be kept clear of all forms of obstructions through the passage of this pertinent regulatory ordinance.

This has to be done now so that we can be on guard for any eventuality.

This is, in fact, was suggested by the Director of the Ospital ng Sampaloc who had the good sense of anticipating a much greater problem should we procrastinate.

Once put in place, it must be implemented without fear or favor. This is the intent of this proposal which this representation hopes will merit the favorable consideration of the august body.

Be it ordained by the City Council of Manila, in session, assembled, THAT:

SECTION 1. This Ordinance shall be known as the HOSPITAL ZONE PROTECTION AND PRESERVATION LAW OF THE CITY OF MANILA.

SEC. 2. Declaration of Policy. - It shall hereby be declared the policy of the City of Manila to protect public health and safety by insuring that all egress and ingress of institutions engaged in the preservation of life shall not be impeded or hampered at any time of the day or night, and especially, during times of natural or man-made emergency and calamity.

SEC. 3. Pursuant to this policy, all forms of obstruction in the frontage and emergency ingress and egress of public and private hospitals in the City of Manila, shall be prohibited.

Corollarily, blowing of horns, revving of engines, playing of karaoke or similar devices that produce loud music, noise or racket, or boisterous behavoir by any person shall be prohibited within the vicinity thereof.

SEC. 4. Penalty Clause. - Any person who violates or infringes this Ordinance, shall be punished as follows:
1. FIRST OFFENSE -    
Censure and a fine of TWO THOUSAND PESOS (PhP. 2,000.00)
2. SECOND OFFENSE -
A fine of THREE THOUSAND PESOS (PhP. 3,000.00)
3. THIRD AND SUBSEQUENT OFFENSE -
A fine of FIVE THOUSAND PESOS (PhP. 5,000.00) or imprisonment of not less than five (5) days at the discretion of the court.
SEC. 5. Effectivity Clause. - This Ordinance shall take effect upon its approval.

This Ordinance was finally enacted by the City Council of Manila on July 22, 2014.
