SANGGUNIANG PANLUNGSOD

"Excerpts from the Minutes of the 71ST Regular Session of the 6th City Council of Valenzuela held on March 23, 2015 at 3:30 P.M. at the City Council's Session Hall, 3rd Floor, Legislative Building, Valenzuela City Hall, Karuhatan, Valenzuela City, Metropolitan Manila.

AN ORDINANCE AMENDING ORDINANCE NO. 2014-190, OTHERWISE KNOWN AS THE "POLICE CLEARANCE AUTOMATION ORDINANCE" AND FOR OTHER PURPOSES.

WHEREAS,
in pursuit of excellency in public service and advancement of the general welfare of residents of the City, it is imperative that modern technologies be utilized and exploited to modernize and improve the delivery of services to its constituency;

WHEREAS, the issuance of POLICE CLEARANCE is one of the frontline services rendered by the Valenzuela City Police Office to the constituents of the City;

WHEREAS, the existing processes and procedures being employed by the Valenzuela City Police Office relative to the issuance of Police Clearance is tedious, costly and time consuming, brought about by the outmoded conventional process and procedure, which likewise poses a security and safety risk, as there is no mechanism in place to verify the authenticity of its origin and the integrity of its contents;

WHEREAS, there is a need to create a centralized database wherein the records of persons who has a pending criminal case and/or who violated the City's Ordinance can be safely and properly recorded;

WHEREAS, in order to automate the issuance, verification and authentication of Police Clearance and to preserve its integrity and authenticity, the Sangguniang Panlungsod believes that the adoption of automation in the issuance and use of an ID based Police Clearance, the authenticity of which can be viewed and verified instantaneously online through readily available technology such as internet enabled devices, will be beneficial to the City and to its constituents;

WHEREAS, in the implementation of the City Government's objective to deliver Simple Speed Service "3S", it needs to adopt to modernization and to utilize existing technology to the effective and efficient delivery of public

NOW, THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Valenzuela in session duly assembled:

SECTION 1. Section 7 is hereby amended to read as follows:

Section 7. Funding and Authority to Enter into Agreement. The amount of Three Million Pesos is hereby allocated for the automation and migration to the ID Based Police Clearance System and the creation of Centralized Police Database to be sourced out from the general funds of the City Government. However, if it is to the best interest of the City, as may be determined by the City Government, thru the Office of the City Mayor, to negotiate and enter into any agreement with any competent service provider who has competent experience and expertise, and who has proprietary right/s over the software system, the City Government thru the City Mayor is hereby authorized to negotiate and enter into such arrangement and apportion accordingly the pertinent Police Clearance fees.

SECTION 2. Section 8 is hereby amended to read as follows:

Section 8. Police Clearance Fees. (a) The following fees shall be collected for every certificate issued to a person requesting issuance of a police clearance;
(1) For employment, scholarship, study grant or other purposes not herein specified........................

(5) For application for Filipino citizenship.........................

The Police Clearance shall be valid for a period of One (1) Year.

SECTION 3. Separability Clause. If for any reason, a part of this Ordinance is declared illegal or invalid, other parts or provisions hereof which are not affected thereby shall remain valid and in full force and effect.

SECTION 4. Repealing Clause. All previous Ordinances, like Ordinance No. 92-012 and rules/regulations inconsistent with the provisions hereof are deemed repealed or modified accordingly.

SECTION 5. Effectivity. This Ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
