SANGGUNIANG PANLUNGSOD

**Exempts from the minutes of the 45th Regular Session of the 6th City Council of Valenzuela held on July 21, 2014 at 2:49 P.M. at the City Council’s Session Hall, 3rd Floor, Legislative Building, Valenzuela City Hall, Kamhatan, Valenzuela City, Metro Manila.

AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 92, SERIES OF 2013 OTHERWISE KNOWN AS "AN ORDINANCE CREATING AND ORGANIZING TASK FORCE DISIPLINA AS CENTRAL IMPLEMENTING BODY OF ORDINANCES OF VALENZUELA CITY AND PROVIDING FOR ITS FUNCTIONS AND DUTIES.

WHEREAS,
Task Force Disiplina is the implementing body of all ordinances and regulations within Valenzuela City;

WHEREAS, the Task Force Disiplina also deputizes barangay personnel to assist in the implementation of ordinances and regulations within their respective barangays;

WHEREAS, there is corresponding allocations for the participating barangays related to the collected fines for infractions committed within their respective jurisdictions.

WHEREAS, there is a need to increase the allocations for the barangays to provide additional benefits for Task Force Disiplina members;

WHEREAS, there is a need to amend Section 4 of Ordinance No. 92, Series of 2013 otherwise known as "AN ORDINANCE CREATING AND ORGANIZING TASK FORCE DISIPLINA AS CENTRAL IMPLEMENTING BODY OF ORDINANCES OF VALENZUELA CITY AND PROVIDING FOR ITS FUNCTIONS AND DUTIES" to provide bigger allocations to participating barangays with respect to collected fines pursuant to the said ordinance;

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the City Council of Valenzuela in session duly assembled the following:

Section 1. Section 4 of Ordinance No. 92, Series of 2013 otherwise known as "AN ORDINANCE CREATING AND ORGANIZING TASK FORCE DISIPLINA AS CENTRAL IMPLEMENTING BODY OF ORDINANCES OF VALENZUELA CITY AND PROVIDING FOR ITS FUNCTIONS AND DUTIES" is hereby amended to read as follows:

"Section 4. Collection of Fines and Allocation - All fines collected by the Task Force Disiplina organic personnel shall fully accrue to the City Government of Valenzuela. Those fines collected thru the joint efforts of the Task Force Disiplina and the deputized barangay personnel or those solely on account of the latter shall be divided in the following manner: one percent (1%) shall be allocated to the City Government of Valenzuela and ninety nine percent (99%) to the respective barangay where the infraction was committed. Those fines collected thru the efforts of Task Force Disiplina and authorized private individual or those solely on account of the latter shall be divided in the following manner: seventy percent (70%) shall be allocated to the Office of the City mayor and thirty percent (30%) to the authorized private individual.

The participating barangay via barangay sangguniang resolution may re-allocate the shares it collected pursuant to this ordinance for purposes of giving additional benefits to the Task Force Disiplina members such as life insurance, health benefits, stipend, rice allowances, operational allowances and the likes.

For purposes of this provision, the City Treasurer shall earmark the collections which should be distributed to the participating barangay personnel and/or private individual and shall be released to them on a quarterly Basis. Provided, the allocation for the Office of the City mayor shall be utilized primarily for the feeding program and scholarship program of the City Government of Valenzuela."


Section 2. In the event that any part or provision of this ordinance shall be held invalid, the other parts or provisions hereto which are not affected thereby shall continue to be in full force and effect.

Section 3. This Ordinance shall take effect within fifteen (15) days after its publication in a newspaper of general circulation.
