WHEREAS, in 1993, Board Resolution No. 8 was passed and approved by the Board of Directors of LLDA, prescribing a surcharge of five percent (5%) per month in case of delay of payment of fishpen registration fee;

WHEREAS, the said surcharge rate has been in effect for 19 years now;

WHEREAS, majority of fishpen and fishcage operators have sought to reconsider said surcharge rate considering that if it is to be computed for one (1) year, such surcharge would mount to sixty percent (60%) of their annual fishpen/fishcage fees;

WHEREAS, the Authority is aware of the economic impacts of several typhoons and monsoons which have affected the fishery business in the Laguna de Bay Region, causing these operators several years of delinquency in the payment of their respective fishpen/fishcage registration fees;

WHEREAS, the Authority now finds subject surcharge rate as unreasonably high based on the records of all delinquent fishpen/fishcage operators, the results of which revealed that many of them operators were not able to pay their surcharge because of such high rate that has accumulated to huge amounts.

WHEREAS, the reduction of surcharge to two and 50/100 percent (2.5%) would also result to positive revenue collections because a large portion of the unpaid amount may still be collected even if the 2.5% will be applied for the 2011 to 2013 registration;

WHEREAS, the objective of such reduction is for all qualified operators to settle all their delayed payments and to clear all accounts for the coming registration years;

NOW, THEREFORE, for and in consideration of the above premises, BE IT RESOLVED, as it is hereby RESOLVED, to approve the reduction of fishpen/fishcage fee surcharge from five percent (5%) to two and 50/100 percent (2.5%), which shall be applied for the years 2011 to 2013 and so forth.

RESOLVED, FURTHER, to authorize the Finance Division through its Division Chief or authorized personnel to reconstruct or re-assess the surcharge based on the new rate of two and 50/100 percent (2.5%) for the applicable years of 2011 to 2013.
