[ PCSD RESOLUTION NO. 13-477, August 02, 2013 ]

CONFIRMING THE ACTION OF THE EXECUTIVE COMMITTEE AUTHORIZING THE PCSDS CASHIER TO COLLECT THE LEGAL RESEARCH FUND FEE FROM ALL APPLICATIONS FOR PERMITS AND LICENSES FOR THE UP LAW CENTER PURSUANT TO REPUBLIC ACT NO. 3870, FURTHER AMENDING THE REVISED PCSD ADMINISTRATIVE ORDER NO. 4, SERIES OF 2010



WHEREAS, Section 16 of Republic Act 7611 provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD), hereinafter referred to as the Council;

WHEREAS, Section 19 paragraph 8 of the same Act empowers the Council adopt, amend and rescind such rules and regulations and impose penalties therefor, for the effective implementation of the SEP law;

WHEREAS, PCSD Administrative Order No. 4, Series of 2000, otherwise known as the “Revised Guidelines on the Imposition of Processing Fees Covering Applications for SEP Clearance of Projects and Undertakings in Palawan” was promulgated by the Council on the 25th day of April 2000, which was amended by PCSD Resolution No. 08-351 on February 29, 2008 and further amended by PCSD Resolution No. 10-411 on September 24, 2010 to provide for the fees and charges in the implementation of the Wildlife Act under Republic Act 9147;

WHEREAS, on May 2, 2013, the PCSD Staff received a copy of the letter addressed to the PCSD Chairman dated November 27, 2012 from Mr. Danilo L. Conception of the UP Law Center requesting PCSD to direct its Cashier to collect the Legal Research Fund Fee for all applications for licenses and permits filed with the PCSD pursuant to Section 4 of Republic Act No. 3870, the law creating the UP Law Center. The said collection, which constitute one percent (1%) of the filing fee or permit fee imposed, but in no case lower than ten pesos (Php10.00) shall be remitted to the Bureau of Treasury for the account of the UP System (UPS Agency Code A0823), Fund Code 187;

WHEREAS, in the Executive Committee meeting on May 31, 2013, this matter was deliberated upon by the members and the aforementioned request of the UP Law Center was approved however the action of the Committee requires the confirmation of the council en banc pursuant to PCSD Resolution No. 99-138;

WHEREFORE, upon motion duly seconded, be it RESOLVED as it is hereby RESOLVED, to confirm as it is hereby confirmed the action of the Executive Committee authorizing the PCSDS Cashier to collect the legal research fund fee from all applications for permits and licenses for the UP Law Center pursuant to RA 3870, further amending the Revised PCSD Administrative Order No. 4, series of 2010.

RESOLVED FINALLY, that copy of this Resolution be furnished the UP Law Center for its information and the Office of the National Administrative Register at the UP Law Center for publication.
