[ PCAB BOARD RESOLUTION NO. 332, S. 2013, August 27, 2013 ]

AUTHORIZING THE COLLECTION OF THE LEGAL RESEARCH FUND (LRF) FEE PURSUANT TO REPUBLIC ACT NO. 3870, AS AMENDED



WHEREAS, Sec. 5 of R.A. 4566 or the Contractor’s License Law, vests upon the Philippine Contractors Accreditation Board (PCAB) the power to issue, suspend or revoke licenses of contractors;

WHEREAS, Sec. 2.1.f. of the Implementing Rules and Regulations (IRR) of R.A. 4566 gives PCAB the authority, among others, to collect fees and undertake income generating activities whenever necessary, to sustain the Board’s performance of its functions and discharge of its responsibilities;

WHEREAS, pursuant to the above provisions, the PCAB prescribed among others, a filing fee of six hundred pesos (P600.00) for all types of license applications and sixty pesos (P60.00) for all types of applications for government registration;

WHEREAS, the UP Law Center informed PCAB that as a government agency that acts on applications for the establishment of a right or privilege, PCAB is required under Sec. 4 of RA. 3870, as amended by PD Nos. 200 and 1856, to collect a Legal Research Fund (LRF) Fee of 1% of the filing fee imposed by it, but in no case lower than Ten Pesos (P10.00) which shall be deposited with the Bureau of Treasury for the account of the UP System (UPS Agency Code A0823), Fund Code “187” pursuant to Treasury Circular No. 2-2008; and

WHEREAS, said additional amount shall, in accordance with law, be for the exclusive use of the U. P. Law Center.

NOW THEREFORE, for and in consideration of the foregoing, the Board during its regular meeting held on 27 August 2013, RESOLVES as it is hereby RESOLVED, to authorize the collection of the Legal Research Fund (LRF) Fee of 1% of the filing fee imposed on all types of license applications and all types of applications for government registration filed with PCAB, but in no case lower than ten pesos (P10.00).

This resolution shall take effect immediately.
