[ CPA MEMORANDUM CIRCULAR NO. 03, July 06, 2012 ]

TERMINAL FEE EXEMPTION OF SENIOR CITIZENS AND PERSONS WITH DISABILITY, AND STUDENT’S DISCOUNT



Pursuant to Section 7 (b), (j) and Section 9 (a), (c) of R.A. 7621 and Board Resolution No. 112-2012, and consistent with the CARES (Convenient, Affordable, Reliable, Efficient, Safe) transport policy of the Department of Transportation and Communications, (DOTC) the following policy guidelines are hereby prescribed:

SECTION 1. Definition of Terms -

a. Senior Citizen – refers to any person, at least 60 years of age, duly registered with the Office of the Senior Citizens Affairs (OSCA) and has a valid Senior Citizen’s Identification Card (ID).

b. Persons with Disability (PWD) – refers to those suffering from restriction of different abilities, as a result of a mental, physical or sensory impairment, to perform an activity in the manner or within the range considered normal for a human being (Sec. 4, R.A. 7277 Magna Carta for Disabled Persons and for Other Purpose), with a transportation discount fare Identification Card (ID) issued by the National Council for the Welfare of Disabled Persons (NCWDP) as required under Section 1 of R.A. No. 9442 (Act Amending R.A. 7277).

c. Student – refers to any person enrolled in any school, college, or university located in the Philippines as evidenced by an identification card (ID) issued by school authorities.

SECTION 2. Exemption of Senior Citizen – All senior citizens with valid ID duly issued by the Office of the Senior Citizens Affairs (OSCA) shall be exempted from the payment of terminal fee. This exemption is personal to the senior citizen concerned and shall not apply to his/her companions who are not senior citizens or who do not have valid senior citizen ID.

SECTION 3. Exemption of Persons with Disability (PWDs). – All Persons with Disability (PWD) upon presentation of a valid transportation discount fare Identification Card (ID) issued by the NCWDP shall likewise be exempted from the payment of terminal fee.

SECTION 4. Student Discount - All students as defined herein shall be entitled to twenty percent (20%) discount in the payment of terminal fee; Provided, that the student presents a current and valid school ID with picture.

SECTION 5. Recording of Exemption and Discount – All exemptions granted to senior citizens and PWDs and discounts granted to students shall be duly recorded by the person collecting the terminal fee. Provided that the person availing of the exemption or discount shall be required to sign in a logbook specifically allocated for the purpose. The records of exemptions and discount granted shall be submitted to the Finance and Administrative Dept. (FAD) of the Authority simultaneous with the report on the terminal fee tickets sold.

SECTION 6. Penalty for Violation - Any violation of this circular or failure to comply with these policy guidelines shall be treated as an administrative offense without prejudice to any other liability of the offender under existing laws.

SECTION 7. Repealing Clause – All circulars, orders, and other issuances or parts thereof, in conflict with this circular hereby repealed or modified accordingly.

SECTION 8. Effectivity Clause – This Memorandum Circular shall take effect within fifteen (15) days after two publications in a newspaper of general circulation.
