AMENDMENTS TO THE REVISED RULES AND PROCEDURES GOVERNING THE ACQUISITION AND DISTRIBUTION OF PRIVATE AGRICULTURAL LANDS UNDER REPUBLIC ACT (R.A.) NO. 6657, AMENDED



PREFATORY STATEMENT

On 30 September 2011, Administrative Order (A.O.) No. 7, Series of 2011, otherwise known as “The Revised Rules and Procedures Governing the Acquisition and Distribution of Private Agricultural Lands under Republic Act (R.A.) No. 6657, as amended”, was issued pursuant to Section 49 of Republic Act (R.A.) No. 6657, as amended, and the overall mandate of the Department of Agrarian Reform (DAR) to implement the Comprehensive Agrarian Reform Program (CARP) and other agrarian reform laws.

Amendments thereto were incorporated thereto on 20 September 2012 to streamline further the Land Acquisition and Distribution (LAD) process.

Last year, bearing in mind this Department’s policy that Notices of Coverage OCs are similar to Summons issued by courts and their issuance therefore will allow this Department to apply Section 30 of R.A. No. 9700 which provides:

“SECTION 30. Resolution of Cases. Any case and/or proceeding involving the implementation of the provisions of Republic Act No. 6657, as amended, which may remain pending on June 30, 2014 shall be allowed to proceed to its finality and be executed even beyond such date.”

this Department committed to complete the issuance of all Notices of Coverage (NOCs) by June 2013. The volume of NOCs to be issued in the coming months may require the DAR to publish these more than twice a month. In view thereof, the foregoing amendment is hereby issued:

SECTION 1. Section 18 of A.O. No. 7, Series of 2011, is hereby amended to read as follows:

“SECTION 18. Publication of NOC. If any of the circumstances under Sections 16 and 17 requires publication of the NOC, the NOC shall be published in a newspaper of general circulation.

“NOCs required to be published shall be sent by the PARO concerned to the BLAD which shall be responsible for publishing the same. All NOCs sent to the BLAD for publication shall be published by the BLAD at the soonest time possible.

SECTION 2. Separability Clause. – Any judicial pronouncement declaring as unconstitutional any provision of this A.O. shall have no effect on the validity of the other provisions thereof.

SECTION 3. Repealing Clause. All order, circulars, rules and regulations inconsistent herewith are hereby revoked, amended, or modified, as the case may be.

SECTION 4. Effectivity. – This Order takes effect ten (10) days after its publication in two (2) national newspapers of general circulation.
