AMENDING MEMORANDUM CIRCULAR NO. 2, SERIES OF 2002, TITLED GUIDELINES FOR THE PROCESSING OF LAND USE CONVERSION APPLICATIONS PURSUANT TO ADMINISTRATIVE ORDER NO. 1, SERIES OF 2002 ENTITLED "2002 COMPREHENSIVE RULES ON LAND USE CONVERSION"

In recognition of the impending energy crisis in our country, the Department of Agrarian Reform (DAR) supports finds it more prudent to accept and process applications for land use conversion involving energy projects, pending the submission of all the documentary requirements under DAR Administrative Order (A.O.) No. 1, Series of 2002, provided the Secretary of the Department of Energy (DOE) issues a certification that the application involves an urgent energy project, and that the said certification is attached to the application.

In view thereof, Section 2 (C) of the DAR MC No. 2, Series of 2002 is hereby amended to read, as follows:

“ Section 2.0 Receipt of Application x x x

(C)
Return the application to the applicant or his/its representative if incomplete/insufficient, except when the application involves an urgent energy project as certified to by the Secretary of the Department of Energy (DOE), the certification of which must be attached to the application.



It is understood that the urgent energy projects processing of all applications for land use conversion involving as certified to by the DOE Secretary in writing, shall continue pending submission of all the documentary requirements under DAR A.O. No. 01, Series of 2002, but cannot be deliberated upon by the Committee on Conversion unless the lacking requirements have been formally submitted.”

This Circular shall take effect immediately.
