AMENDMENT TO ADMINISTRATIVE ORDER NO. 11, SERIES OF 2014

SECTION 1. There shall be incorporated after Section 1 of Administrative Order (A.O.) No. 11, Series of 2014, a new section to read as follows:

SECTION 1-A. Definition of “Party-in-Interest”. - For purposes of this A.O., the term “party-in-interest” shall refer to any of the following:

(a)
Farmers alleging to be tenants, farmworkers, or actual tillers of the land sought to be covered;
(b)
Associations of those mentioned in (a), regardless if these associations are registered with the Securities and Exchange Commission, or Cooperative Development Authority, or not;
(c)
Civil society organizations and People’s organizations advocating for the completion of the Comprehensive Agrarian Reform Program (CARP); and
(d)
Such other persons interested in the completion of CARP and have personal knowledge that the land sought to be covered exists and may be covered by CARP.

SECTION 2. The first paragraph of Section 2 of A.O. No. 11, Series of 2014 is hereby amended to read as follows:

SECTION 2. Commencement - Any request or petition for coverage shall be commenced by the filing of an initiatory pleading or petition before the Regional Director (RD) having territorial jurisdiction over the subject landholding/s.

SECTION 3. The last paragraph of Section 5 of A.O. No. 11, Series of 2014 is hereby repealed, and said Section is hereby amended to read as follows:

SECTION 5. Disclosure Statement - The petitioner and the respondent shall disclose and certify under oath, in the petition or its integral annex, that:

(a)
He is a parry-in-interest or properly authorized by a party-in-interest, in case of the petitioner, or the fact that he is the respondent, in such case;
(b)
He has not commenced and/or is aware of any other action or proceeding involving the same land, or a portion thereof, or issue in any court, tribunal, or quasi-judicial agency; and to the best of his knowledge, no such action or proceeding is pending in any court, tribunal, or quasi- Judicial agency;
(c)
If there is any action or proceeding which is either pending or may have been terminated, he shall state the status thereof; and
(d)
If he thereafter learns that a similar action or proceeding has been filed or is pending before any court, tribunal, or quasi-judicial agency, he undertakes to report that fact within five (5) days therefrom to the DAR Office where the case for Petition for Coverage is pending.

SECTION 4. Repealing Clause. - All orders, circulars, rules and regulations, and issuances or portions thereof inconsistent herewith are hereby accordingly deemed repealed or modified.

SECTION 5. Separability Clause. - Any judicial pronouncement declaring as unconstitutional any provision hereof shall have no effect on the validity of the other provisions not affected thereby.

SECTION 6. Effectivity Clause. - This A.O. shall take effect immediately after its publication in two (2) newspapers of general circulation.
