GUIDELINES TO GOVERN THE ACCREDITATION OF GPS DEVICE PROVIDERS

PURSUANT TO SECTION 5, PARAGRAPH (K) OF EXECUTIVE ORDER NO. 202 EMPOWERING THE BOARD “TO FORMULATE, PROMULGATE, ADMINISTER, IMPLEMENT AND ENFORCE RULES AND REGULATIONS ON LAND TRANSPORTATION PUBLIC UTILITIES, STANDARDS OF MEASUREMENTS AND/OR DESIGN, AND RULES AND REGULATIONS REQUIRING OPERATORS OF ANY PUBLIC LAND TRANSPORTATION SERVICE TO EQUIP, INSTALL AND PROVIDE IN THEIR STATIONS SUCH DEVICES, EQUIPMENT FACILITIES AND OPERATING PROCEDURES AND TECHNIQUES AS MAY PROMOTE SAFETY, PROTECTION, COMFORT AND CONVENIENCE TO PERSONS AND PROPERTY IN THEIR CHARGES AS WELL AS THE SAFETY OF PERSONS AND PROPERTY WITHIN THEIR AREAS OF OPERATION,” THE FOLLOWING GUIDELINES GOVERNING THE ACCREDITATION OF GLOBAL POSITIONING SYSTEM (GPS) DEVICE PROVIDERS ARE HEREBY PROMULGATED.

I. GPS FLEET MANAGEMENT SYSTEM

All GPS devices shall conform to the specifications set forth by the Board in coordination with the Department of Science and Technology – Advance Science and Technology Institute (DOST - ASTI), to wit:

To make the format extensible, headers must be placed before each data value.

ID# : GPS ID provided by GPS Registration System (8-12 characters)
TM# : Time of GPS reading in HH:MM:SS format
DT# : Date of GPS reading in YYYY-MM-DD format
LT# : Latitude reading in DDD.dddddd
LN# : Longitude reading in DDD.dddddd
AT# : Altitude reading in meters
SP# : Speed reading in km per hour
CO# : Course/Heading in degrees (0 degrees = north, 90 degrees = east, etc)

During Operation





The firmware of the GPS device must be able to perform the following:
Send the General Packet Radio Service (GPRS) data to the server via Transmission Control Protocol (TCP) or User Date Protocol (UDP) on a pre-defined interval with the correct format.
Only data streams required should be sent to the server.
Device must be able to send data to the server at least every 30 seconds.
Settings have the provision to be remotely configured via Short Message Service (SMS) or Global System for Mobile (GSM) or GPRS including but not limited to:
-
sending time
-
IP address
-
port.
Handle GPS signal loss or erratic readings
-
if received data is erratic, last good known coordinates will be sent.
Handle GSM signal loss
-

in the absence of GSM signal, all data will be stored and will be sent once GSM signal is again detected.

Log sent data.
Has provision for direct download of data logs to personal computer.


II. APPLICATION FOR ACCREDITATION

An Application for the Issuance of a Certificate of Accreditation shall be made in writing on a form provided by the Board, and signed and sworn to by the applicant, or if the applicant is a juridical entity, by its duly authorized representative. Each Application, in addition to other documents that are required, shall submit at a minimum the following:

1)
If the applicant is an individual:
a.
Full Name;
b.
Residence Address;
c.
Business Address;
d.
Business Email Address;
e.
Business Telephone Number;
f.
Business Name Registration duly issued by the Department of Trade and industry; and,
g.
Proof that the Applicant is at least Eighteen (18) Years of Age.



2)
If the applicant is a resident domestic or foreign juridical entity:
a.
Corporate/Partnership Name;
b.
Business Address;
c.
Business E-mail Address;
d.
Business Telephone Number;
e.
Certification of Registration of Incorporation/Partnership issued by the Securities and Exchange Commission (SEC);
f.
Articles of Incorporation/Partnership and By-Laws;
g.
Secretary’s Certificate of the Board/Partnership Resolution authorizing the representative to sign the Application for Accreditation for and in behalf of the corporation/partnership; and,
h.
Secretary’s Certificate of Incumbent Corporate/Partnership Officers and List of Directors/Partners.



3)
If t he applicant is a non-resident foreign entity:
a.
Corporate/Partnership Name;
b.
Business Address;
c.
Business E-mail Address;
d.
Business Telephone Number;
e.
Authenticated Copy of the Articles of Incorporation/Partnership with an English Translation thereof it in foreign language other than English;
f.
License To Do Business in the Philippines duly issued by the SEC;
g.
Authenticated Copy of the Board Resolution authorizing the establishment of a Branch/Representative Office in the Philippines;
h.
List of Incumbent Officers and Directors;
i.
Authenticated Copy of the Board/Partnership Resolution authorizing the representative to sign the Application for Accreditation for and in behalf of the foreign entity;
j.
Authenticated Copy of the Board/Partnership Resolution designating the Resident Agent to whom summons and other legal processes may be served in behalf of corporation/partnership; and,
k.
Authenticated Copy of the Board/Partnership Resolution stipulating that in the absence of such Agent or upon cessation of its business in the Philippines, any summons or legal processes may be served to SEC as if the same is made upon the corporation at its home office.


III. OTHER REQUIREMENTS

The following shall also be attached upon filing of the Application for Accreditation:

1)
Complete Description of Business Model;
2)
Compliance with Item I hereof;
3)
Proof of business existence as GPS provider for at least two (2) years, such as but not limited to the following;
a)
Business Permit duly issued by the local government where the applicant’s principal place of business is located for the last 2 years;
b)
Certificate of Registration duly issued by the Bureau of Internal Revenue for the last 2 years;
c)
List of All Clients (with contact person, address and telephone/mobile number) in the Transportation Industry for the last 2 years;
4)
Number of GPS Device Installers and/or Technicians;
5)
National Bureau of Investigation Clearance of GPS Device Installers and/or Technicians;
6)
24/7 Nationwide Technical Support;
7)
Warranty of the GPS Device, which shall not be less than one (1) year from installation;
8)
Proposed Procedure for Repair and Replacement of Defective GPS Device;
9)
Undertaking of the applicant to comply with the provisions of PMS ISO/IEC 17025, within 1 year from accreditation, if applicable; and,
10)
Company policy and procedure for resolution of complaints from the operators.


IV. ACCREDITATION FEE


There shall be a non-refundable Accreditation Fee in the amount of Ten Thousand Pesos (Php10,000.00). Said fee shall be paid before filing of the Application for a Certificate of Accreditation.

V. VALIDITY OF THE CERTIFICATE OF ACCREDITATION


The Certificate of Accreditation shall be issued to any applicant, who/that complies with all the requirements prescribed above, for a period of one (1) year from issuance thereof and may be renewed. Application for renewal must be filed within three (3) months before expiration.

The Certificate shall be non-transferable.

VI. REPORTS


The Accredited GPS Providers shall report within twenty four (24) hours if an installed GPS Device has been disconnected by them for whatever reason.

The Accredited GPS Providers shall likewise submit to the Board a quarterly report of all available stocks of GPS device.

VII. ACCREDITATION COMMITTEE


An Accreditation Committee is hereby created and shall be composed of the following:

Executive Director - Chairman
Chief, Information Systems Management Division - Vice-Chairman
Chief, Technical Division – Member
Information Technology Officer II – Member
Legal Officer- Member


The Committee shall evaluate all Applications filed and recommend to the Board for approval or disapproval of any Application.

Upon effectivity of this Circular, any interested applicant may file an Application, together with all the required documents, before the Committee, through the Office of the Executive Director. Any Applicant, who/that fails to submit or comply with any of the requirements prescribed above without any justifiable reason, shall be disqualified outright without any need of further evaluation.

All other issuances or parts hereof inconsistent herewith are hereby modified, amended or superseded accordingly.

This Circular shall take effect immediately following its publication in a newspaper of general circulation. Let three (3) copies hereof be filed with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated October 9, 1992.
