[ MMDA RESOLUTION NO. 13-10, March 22, 2013 ]

ADOPTING RULES ON THE USE OF ROADS IN METRO MANILA IN CONDUCTING FUN RUNS, MOTORCADES, FILMING AND OTHER SPECIAL EVENTS



WHEREAS, RA 7924 mandates MMDA to provide Transport and Traffic Management which includes the formulation, coordination and monitoring policies, standards, programs and projects to rationalize the existing transport operations, infrastructure requirements, the use of thoroughfares, and promotions of safe and convenient movement of persons and goods, provisions for the mass transport system and the institution of a system to regulate road users, administration and implementation of all traffic enforcement operations, traffic engineering services and traffic education programs, including the institution of a single ticketing system in Metropolitan Manila;

WHEREAS, the imposition of service and regulatory fees, such as payments for securing certifications, clearances and copies of public documents, are sanctioned by powers and duties that are expressly granted by law under RA 7924, which provides:

“Sec. 6 (d) Functions of the Metro Manila Council. - xxx
- (d) It shall promulgate rules and regulations and set policies and standards for metro-wide application governing the delivery of basic services, prescribe and collect service and regulatory fees and impose and collect fines and penalties.”

WHEREAS, it has been observed that fun runs and other similar events has become common means of private and public sectors in raising funds for charitable institutions and other benevolent organizations;

WHEREAS, these events are mostly conducted along major thoroughfares of Metro Manila which cause traffic chaos all over the metropolis;

WHEREAS, during these events the MMDA utilizes its own resources such as traffic personnel, motorcycles, ambulance vehicles, fuel and other traffic facilities, in assisting said events without cost;

WHEREAS, the Metro Manila Council after due deliberation in session duly assembled, recognizes the need to regulate the use of major thoroughfares in Metro Manila and instead encourage the organizers to use secondary roads to avoid traffic congestion in conducting fun runs, motorcades, filming and other special events;

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Sec. 6 of RA 7924, that the Council hereby promulgates the following rules on the use of roads for fun runs, motorcades, filming and other special events:

Section 1. Issuance of Permit. - The organizers of any special event such as but not limited to filming, motorcades or fun runs shall, upon compliance with all the necessary requirements from the relevant local government unit or units, secure a Roadway Private Utilization Permit (RPUP) from the MMDA with the following conditions:

a)
The applicant shall accomplish an application form supplied by the office of the Assistant General Manager for Operations. The application shall state the name of the requesting party, subject of the request, validity period, time and location of the event;
b)
The applicant-organizer must submit to the concerned LGU and MMDA at least fourteen (14) days prior to the proposed event a Traffic Management Plan (TMP);
c)
The RPUP shall not supplant other permits that should be secured from the Local Government Units (LGUs) concerned pursuant to existing laws or local ordinances;
d)
Issuance of the RPUP shall not exempt the requesting party from strictly observing traffic rules and regulations; and
e)
The period and time of the event granted under the RPUP shall be strictly observed.

Section 2. Covered Area. - This permit shall be required where the proposed event is to be conducted in an area that is within jurisdiction of MMDA (e.g. within the major thoroughfares of Metro Manila). Provided however, that this permit shall also be obtained by the organizers even if the proposed event will be conducted within secondary roads where such event will have an effect on any major thoroughfare’s traffic situation.

Section 3. Cash Bond. - The applicant shall deposit a cash bond in the amount of one thousand pesos (P1,000) for every lane and kilometer affected by the event but no less than five thousand (P5,000.00) pesos. The cash bond shall cover all reasonable expenses and costs for covering the said event, the balance whereof shall be refunded to the organizers ten (10) days after the event. Provided, however, that the Authority shall not be precluded from collecting the actual amount incurred in excess of the deposited cash bond.

Section 4. Revocation of Permit. – Violation of any of the provisions set forth in the RPUP shall ipso facto revoke the Roadway Private Utilization Permit.

Subject to traffic and security conditions, the MMDA may revoke the permit issued without prior notice.

Section 5. Separability Clause. - If any part, section or provision of this Resolution is declared invalid or unconstitutional, the part, section or provision not affected thereby shall continue to be enforced and effective.

Section 6. Effectivity Clause. - This Resolution shall take effect after fifteen (15) days following its publication in at least two (2) newspapers of general circulation.

RESOLVED FINALLY, to authorize the MMDA Chairman to issue the necessary guidelines to implement this Resolution.
