PENALTIES FOR WILLFUL VIOLATION OF PHILRACOM RULES COMMITTED BY HORSE OWNERS AND OTHER LICENSEES

WHEREAS, Presidential Decree No. 420 gives the Commission exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;

WHEREAS, the same law gives the Commission the power to prescribe additional rules and regulations not otherwise inconsistent therewith and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;

NOW THEREFORE, be it RESOLVED, as it is hereby RESOLVED that the following provision be added to Unit II, Chapter 3 of the Rules and Regulations Governing Horse Racing Participants, thus:

PR 27. PENALTIES FOR WILLFUL VIOLATION OF PHILRACOM RULES COMMITTED BY HORSE OWNERS

If, after notice and hearing, the Commission finds that the horse owner has willfully violated any of the PHlLRACOM Rules other than those provided under PR 74 and PR 75, or has committed an act punishable by the Revised Penal Code within the premises of the racing club or in the performance of or in connection with his duties, he shall be made liable to pay a fine in an amount not less than Five Thousand Pesos (P5,000.00) but not more than Fifty Thousand Pesos (P50,000.00), at the discretion of the Commission, without prejudice to other penalties that the Commission may impose under the Rules, such as suspension or revocation of license.”

RESOLVED FURTHER that the following provision be added to Unit III, Chapter 7 of the Rules and Regulations Governing Horse Racing Participants, thus:

PR 74-A. PENALTIES FOR WILLFUL VIOLATION OF PHILRACOM RULES COMMITTED BY OTHER LICENSEES

If, after notice and hearing, the Commission finds that the licensee thereof other than a racing manager, steward, club handicapper, horse owner, horse trainer or jockey has willfully violated any of the PHlLRACOM Rules other than those provided under PR 74, or has committed an act punishable by the Revised Penal Code within the premises of the racing club or in the performance of or in connection with his duties, he shall be made liable to pay a fine in an amount not less than Five Hundred Pesos (P500.00) but not more than Two Thousand Pesos (P2,000.00), at the discretion of the Commission, without prejudice to other penalties that the Commission may impose under the Rules, such as suspension or revocation of license.”

RESOLVED, FINALLY, that the amendments to the Philracom Rules provided in this Resolution shall be effective fifteen (15) days upon publication thereof.
