REVISED FEES AND CHARGES OF THE AIRMEN EXAMINATION BOARD

WHEREAS, in compliance with Administrative Order No. 31 dated October 1, 2012 as implemented by DOF-DBM-NEDA Joint Circular No. 1-2013 dated January 30, 2013 of the Department of Budget and Management and National Economic and Development Authority and pursuant to Republic Act Number 9497 otherwise known as the “Civil Aviation Authority Act of 2008”, the Civil Authority of the Philippines (CAAP) has been created as an independent regulatory body with quasi-judicial and quasi-legislative powers and possessing corporate attributes;

WHEREAS, the Schedule of Fees and Charges which are being implemented under the jurisdiction of Civil Authority of the Philippines (CAAP) are those provided for under Department Order Number 2002-57;

WHEREAS, the rates of examination of Airmen Examination Board (AEB) under the jurisdiction of Civil Aviation Authority of the Philippines (CAAP) have not been increased the remained unchanged overtime;

WHEREAS, Section 17 - Schedule of Fees and Charges states that “The Authority shall adopt and publish its schedule of fees and charges. The Authority shall hold such public hearings or consultative meetings with stakeholders in the industry before adopting its schedule of fees and charges. The Authority shall not revise its schedule of fees and fines more than once every three (3) years”.

WHEREAS, Section 15 - Setting of Fees and Charges states that “The Board, after consultation with the Director General, and after public hearing, shall determine, fix, impose, collect or receive reasonable charges, fees, dues or assessment in respect of aviation certificates, licenses, and all other authorizations or permission authorized to be issued under this Act and all services performed by the Authority. All charges and fees shall be formally promulgated in accordance with the requirements of the Administrative Code of the Philippines or any amendment or successor thereto. Pending the promulgation of such new schedule of charges and fees, the current charges and fees of the ATO shall continue to apply”.

WHEREAS, the objective of the increase on fees and charges is for the government to recover investments and services rendered, as well as the cost of Maintenance and Other Operating Expenses (MOOE) to provide better and more efficient services to stakeholders;

WHEREAS, on March 3, 2011, the Board of Directors of CAAP through its Resolution No. 2011-013 approved the request of Management to conduct public hearings on the Revised Fees and Charges for all CAAP Imposed Fees and Charges, subject to its final submission and approval;

WHEREAS, the Notice of Public Hearing/Consultation relative to the proposed increase in the Fees and Charges of the Airmen Examination Board was published in two (2) newspapers of general circulation, specifically the Manila Times and Manila Standard Today on August 15 & 23, 2014.

WHEREAS, the Committee on the Revised Fees and Charges held Public Hearings/Consultations on the Proposed Rates on September 2 and 4, 2014 at the Civil Aviation Training Center and encountered no opposition from the stakeholders.

WHEREAS, pursuant to its mandate under Section 15 and 17 of Republic Act 9497, the CAAP Board, after consultation with the Director General and after Public Hearings, has approved the implementation of the schedule increase in fees and charges of Airmen Examination Board for its theoretical examination, under the hereunder rules and guidelines;

PART I. DEFINITIONS OF TERMS

Authority – Refers to the Civil Aviation Authority of the Philippines
CAAP – Acronym for Civil Aviation Authority of the Philippines
CAAP Board – The Board of the Civil Aviation Authority of the Philippines
Director General – The Director General of the Civil Aviation Authority of the Philippines
DOTC – Acronym for Department of Transportation and Communications
COR – Certification of Official Release
AEB – Airmen Examination Board

PART II. GENERAL PROVISIONS

Section 1. APPLICABILITY

The charges prescribed herein shall be applicable to all airmen and all other persons who wish to take theoretical examination for the issuance of airmen licenses and other charges related thereto.

Section 2. OTHER FEES AND CHARGES

The fees and charges prescribed herein shall not prejudice the right of the CAAP to impose and collect such other reasonable charges as maybe determined by the Director General.

WHEREFORE, RESOLVED as it is hereby RESOLVED, that the recommendation of the Director General to implement the hereunder revised fees and charges of the Airmen Examination Board effective 25 September 2015 is hereby APPROVED, as follows:

PART III. REPEALING CLAUSE

All previous Order, Rules and Regulations or parts thereof, which are inconsistent with any of the provisions hereof are hereby amended, revoked or modified accordingly.

PART IV. EFFECTIVITY

This Circular will take effect fifteen (15) days after compliance with the requisite single publication in two (2) newspapers of general circulation in the Philippines and a copy filed with the UP Law Center-Office of the National Administrative Register.
