[ BUREAU OF PHILIPPINE STANDARDS MEMORANDUM CIRCULAR NO. 14-1, February 14, 2014 ]

MARKING AND LABELLING OF GALVANIZED IRON SHEETS USED FOR ROOFING



WHEREAS, Article 7(b) of Republic Act (RA) 7394, otherwise known as the Consumer Act of the Philippines, the concerned department, in this case the Department of Trade and Industry (DTI), shall establish consumer quality and safety standards which shall provide the requirements as to the kind, class, grade, dimensions, weight and material of the consumer products;

WHEREAS, Article 77, 78 and 79 of RA 7394 provides for the minimum labelling requirements for all consumer products domestically sold whether manufactured locally or imported;

WHEREAS, BPS Memorandum Circular No. 01, Series of 2011 issued last 17 February 2011, stated that to ensure protection of consumers, the DTI Regional and Provincial Office are requested to monitor compliance of companies not with standard but on marking and labelling per Republic Act 7394-Consumer Act of the Philippines i.e thickness declaration on labels and markings against actual thickness;

WHEREAS, full disclosure of labels and markings support the consumers right to information and choice;

WHEREAS, Article 164 (e) of RA 7394 provide for a maximum penalty of Three Hundred Thousand Pesos (PhP300,000.00) for the violation of the law.

NOW THEREFORE, in order to ensure the protection of consumers, the following measures are hereby reiterated.

I. Minimum Labels and Marking requirements

a. Company name, brand name, and address of the manufacturer;
b. Thickness in “mm”;
c. Width in “mm”
d. Date of manufacture (month and year); and
e. The term “FOR ROOFING USE”

II. Administrative Investigation

Complaints for violations of this Order shall be subject to the provisions of the following:

1.
RA 7394 or the Consumer Act of the Philippines and its Implementing Rules and Regulations;
2.
Department Administrative Order No. 7, Series of 2006, entitled Instituting the Simplified and Uniform Rules of Procedure for Administrative Cases Filed with the Department of Trade and Industry (DTI) for Violations of the Consumer Act of the Philippines and Other Trade and Industry Laws shall be applicable in violation of Articles 77, 78 and 79 of RA 7394; and
3.
Department Order No. 48, Series of 2008 entitled DTI’s General Enforcement Guidelines for Trade and Industry and Consumer Cases.

III. Publication

This Memorandum Circular shall be published in a newspaper of general circulation. Three (3) copies of this Memorandum Circular shall be submitted to the National Administrative Register at the University of the Philippines Law Center and the Official Gazette.
