REVOCATION OF BPS MEMORANDUM CIRCULAR NO. 01 SERIES OF 2011, “DEFERMENT OF THE IMPLEMENTATION OF MEMORANDUM CIRCULAR NO. 01 SERIES OF 2010, IMPLEMENTING GUIDELINES FOR THE MANDATORY CERTIFICATION OF PNS 67:2009 - HOT-DIP METALLIC- COATED STEEL SHEETS FOR ROOFING-SPECIFICATION



WHEREAS, in 17 February 2011 the Bureau of Product Standards (BPS) issued Memorandum Circular No. 01 Series of 2011, deferring the implementation of BPS Memorandum Circular No. 01 series of 2010, “Implementing Guidelines for the Mandatory Certification of PNS 67:2009 - Hotdip metallic- coated steel sheets for roofing-specification.”;

WHEREAS, the injunction issued by the Regional Trial Court (RTC) of Pasay City Branch 112 is effective only in the territorial jurisdiction of the National Capital Judicial Region;

WHEREAS, the natural calamities that struck the country had placed premium to the compliance by the stakeholders that locally manufactured and imported galvanized flat or corrugated metal products for ROOFING shall comply with the requirements of the Philippine National Standard (PNS) 67:2009 and future revision, and its implementing guidelines;

NOW THEREFORE, the following are hereby issued:

  1. In order to ensure the protection of consumers, the Bureau of Product Standard (BPS) Memorandum Circular No. 01 series of 2011 is hereby revoke; except in the territorial jurisdiction of the National Capital Judicial Region;
  2. Bureau of Product Standards (BPS) Memorandum Circular No. 01 Series of 2010, “Implementing Guidelines for the Mandatory Certification of PNS 67:2009 - Hot-dip metallic-coated steel sheets for roofing-specification.” is reinstated accordingly, except in the territorial jurisdiction of the National Capital Judicial Region.

Effectivity

To ensure orderly compliance, page 11 on Effectivity is hereby amended as follows:

This Memorandum Circular shall take effect upon publication in newspapers of general circulation. Three (3) copies of this Memorandum Circular shall be submitted to the National Administrative Register at the University of the Philippines Law Center and in the Official Gazette.
