[ GSIS RESOLUTION NO. 89, September 12, 2013 ]

IMPOSING SIX PERCENT (6%) PER ANNUM ON THE PPD OSTEOARTHRITIS ACCOUNTS THAT REMAIN UNPAID AFTER EXTRA-JUDICIAL DEMAND



WHEREAS, the Board, in its Resolution No. 137 dated 2 May 2000, provided Operating Guidelines in the processing and evaluation of claims for Permanent Partial Disability (PPD) benefits due to Osteoarthritis;

WHEREAS, in 2004, the Commission on Audit (COA) issued Notices of Disallowance on payments made by the then Social Insurance Department for PPD Osteoarthritis, and also recommended the immediate refund- by the concerned members/claimants of the amount paid by the GSIS;

WHEREAS, the NCR, Luzon, and VisMin Operations Groups embarked on a massive cleansing project of the remaining unpaid PPD Osteoarthritis accounts during the fourth quarter of 2012;

WHEREAS, collection letters have been sent to all members/claimants with remaining receivables from their disallowed PPD Osteoarthritis benefits;

WHEREAS, the Legal Services Group, in a Memorandum dated 15 April 2013, confirmed that the interest rate that should be imposed is six percent (6%) per annum from the time of extra-judicial demand;

RESOLVED, to impose six percent (6%) per annum on the PPD Osteoarthritis accounts that remain unpaid after extra-judicial demand, as recommended by the Operations Group and the Legal Services Group;

RESOLVED FURTHER, that Board Resolution No. 17 dated 14 February 2013 is hereby REVOKED.
