AN ORDINANCE GRANTING BURIAL ASSISTANCE TO THE SURVIVING HEIRS OF SENIOR CITIZENS WHO HAVE DIED AND APPROPRIATING FUNDS FOR THE PURPOSE

PREAMBLE

WHEREAS, Article II, Section 15, of the 1987 Philippine Constitution mandates the State to promote a just and dynamic social order that will ensure the prosperity and indenpendence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living and an improvement quality of life for all;

WHEREAS, Article XV, Section 4, of the Constitution further declares that while it is the duty of every family to take care of its elderly members, the State may also so by instituting social programs for them;

WHEREAS, pursuant to the foregoing constitutioanl principles and taking into account the fact that senior citizens are an integral part of our society, the City Council and Manila has enacted various ordinances granting benefits and privileges to them for their improvement and well-being;

WHEREAS, as a way to further honor the city's senior citizens and give due recognition to their lifetime, the surviving heirs of senior who have died should be given burial financial assistance to help them cope with rising funeral expenses: NOW, THEREFORE,

Be it ordained by the City Council of Manila, in session assembled, THAT:

SECTION 1. Definition – "Senior citizen" shall refer to any Filipino citizen aged 60 or older who has been a resident of the City of Manila for a period of at least one (1) year.

SEC. 2. Burial Financial Assistance. – The surviving heirs of any senior citizen who has died shall be granted burial financial assistance in the amount of Five Thousand Pesos (PhP. 5,000.00), subject to the presentation by such heirs of proper identification and any other pertinent documents which the Office of the Senior Citizen Affairs may reasonably require.

SEC. 3. Appropriation. – The amount of Ten Million Pesos (PhP. 10,000,000.00), or so much thereof as may be necessary, is hereby appropriated out of the funds in the City Treasury not otherwise appropriated, for the purpose of such financial assistance, for inclusion in the next year budget; for this year, Ten Million Pesos, (PhP. 10,000,000.00), shall be sourced from the Special Activities Fund of the Mayor for the year 2016.

SEC. 4. Effectivity Clause. – This Ordinance shall take effect upon its approval.

This Ordinance was finally enacted by the City Council of Manila on March 15, 2016.
