AN ORDINANCE PROVIDING FREE HOUSING AT BASECO HOUSING PROJECT

Be it ordained by the City Council of Manila, in session assembled, THAT:

SECTION 1. There shall be a Baseco Housing Project funded from the Department of Interior and Local Government (DILG) Seed Grant in the amount of Thirty-Six Million Pesos (Php. 36,000,000.00) and the counterpart road network and site development from the City of Manila.

SEC. 2. Since the funds for the housing project came from the DILG, the housing shall be transferred to the beneficiaries by usufruct only.

SEC. 3. The Beneficiaries shall be chosen in accordance with the Code of Policy as approved by the Local housing Board.

SEC. 4. Ownership of the housing project shall remain with the City of Manila.  Beneficiaries shall have usufruct of the housing units, subject to the following conditions:
  1. That beneficiaries shall not sell or transfer or lease the use of the housing units.  The sale or transfer or lease of the units shall be void and the city, together with the barangay officials, shall evict the transferee or lessee or any occupant who is not a beneficiary of the project;

  2. The housing unit shall be transferred to a new beneficiary is accordance with the prioritization as contained in the validated list as approved by the Manila Social Welfare Department;

  3. That the housing units shall be not be modified by extending to the front, back or sides of the housing units.  Extensions shall be subject to demolition by the barangay officials who shall be tasked with the maintenance of the public areas of the housing project together with the homeowners association.

  4. That extension and improvements shall only be allowed vertically upon complaince with Building laws, local ordinances, rules and regulations; and

  5. That beneficiaries shall organize themselves into a homeowners association and provide for rules and regulations to maintain peace and order traffic, sanitation, cleanliness in the housing project.

SEC. 6. The Urban Settlements Office and the Local Inter-Agency Committee shall conduct an orientation with the beneficiaries of the project on the rules and regulations for use of the housing units as contained in this Ordinance.

SEC. 7. This Ordinance shall be strictly implemented by the Urban Settlements Office, the homeowners association and the Sangguniang Barangay of Baseco.

SEC. 8. This ordinance shall take effect upon the completion of the project and the housing units are turned over to the beneficiaries.

This Ordinance was finally enacted by the City Council of Manila on June 14, 2016.
