AN ORDINANCE REQUIRING ALL FUNERAL ESTABLISHMENTS AND ENTITIES UNDERTAKING SIMILAR SERVICES IN QUEZON CITY TO PROVIDE THEIR CLIENTS A FULL DISCLOSURE OF THEIR FUNERAL SERVICES IN WRITING, STATING THEREIN THE SPECIFIC DETAILS OF EACH OF THEIR SERVICE AS WELL AS THE COSTS, BEFORE RENDERING ANY SERVICE TO THE DECEASED BODY AND PROVIDING PENALTIES FOR VIOLATION THEREOF

WHEREAS, the increasing prohibitive costs of funeral services in our country exacerbates economic hardships on most of our affected constituents, especially those on or below the poverty line level;

WHEREAS, since death is undeniably a fact of life and an Inevitability, it is important to recognize that provision for funeral and memorial services for departed members of the family is a basic and essential need in every community;

WHEREAS, recognizing the substantial cost and Importance of funeral and memorial services, it is the responsibility and concern of the Quezon City Government to promote fairness, honesty, and transparency in all business transactions on funeral and memorial services provided by funeral establishments and other entities undertaking similar services with the families of the deceased who avail of their services.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:

SECTION 1. SHORT TITLE. This Ordinance shall be known as the "Quezon City Funeral Establishments Full Disclosure of Funeral Services and Rates".

SECTION 2. PURPOSE. This Ordinance seeks to require all funeral establishments and other entitles undertaking similar services in Quezon City to provide their customers (the families of the deceased) a full disclosure in writing or a written contract of all the funeral services, prices, and other terms and conditions which were agreed to by the funeral establishments and their customers before the full completion of the performance of funeral and memorial services in order to promote fairness, honesty, and transparency in all transactions between the bereaved families and funeral establishments.

SECTION 3. FULL DISCLOSURE OF FUNERAL SERVICES. All funeral establishments and entities undertaking similar services in Quezon City are hereby required to provide the family or relatives of the deceased a full disclosure of their funeral services in writing, stating therein the specific details of each of their service as well as the costs, before rendering or undertaking any service to the body of the deceased.

SECTION 4. PENALTIES. Any funeral establishment and/or its undertakers or agents, who shall be found violating any of the above provisions, shall be held liable as follows:
First (1st) Offense: A fine of not less than One Thousand Pesos (Php1,000.00);

Second (2nd) Offense: A fine of more than One Thousand Pesos (Php1,000.00) but not exceeding Three Thousand Pesos (Php3,000.00) and/or suspension of business permit;

Third (3rd) Offense: A fine not exceeding Five Thousand Pesos (Php5,000.00) and cancellation of business permit to operate.
SECTION 5. IMPLEMENTING RULES AND REGULATIONS. The Social Services Development Department (SSDD), Business Permits and Licensing Office (BPLO) and other concerned agencies shall be enjoined in the crafting of the Implementing Rules and Regulations of this Ordinance.

SECTION 6. SEPARABILITY CLAUSE. Should any provision of this Ordinance be declared unconstitutional or illegal by any court of competent jurisdiction, those parts that are not so declared shall remain in full force and effect.

SECTION 7. REPEALING CLAUSE. Any previous Ordinance/s or parts thereof, which are inconsistent with this Ordinance are hereby repealed or superseded accordingly.

SECTION 8. EFFECTIVITY CLAUSE. This Ordinance shall take effect upon its approval.
