AN ORDINANCE CONVERTING 1ST STREET, CASTILLA STREET AND VALENCIA STREET INCLUDING VALENCIA LOOP IN BARANGAY VALENCIA INTO ONE-WAY STREET.

WHEREAS, Section 458 (a) (5) (iv) and (iv) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that:
"(v) Regulate the use of streets, avenue, alleys, sidewalks, bridges, parks and other public places and approve the construction, improvement, repair and maintenance of the same...;
   
"(vi) Regulate traffic on all streets and bridges, prohibit encroachments or obstacles thereon and when necessary in the interest of public welfare".

WHEREAS, the Sangguniang Barangay of Barangay Valencia passed Resolution No. 53, Series of 2014, entitled:
"A Barangay Resolution Requesting the Quezon City Council to convert 1st Street, Castilla Street, and Valencia Street including Valencia Loop into One Way Street."
WHEREAS, the increasing commercial activities in Barangay Valencia resulted in the increase of traffic volume;

WHEREAS, 1st Street, Castilla Street and Valencia Street in Barangay Valencia Quezon City are narrow two-(2) lanes roads just enough to accommodate two (2) vehicles travelling in opposite directions;

WHEREAS, indiscriminate parking along the same roads exacerbate the worsening flow of vehicular traffic;

WHEREAS, the necessity of converting the said streets from two (2) way to one (1) way thoroughfare for a smooth and orderly flow traffic is evident;

WHEREAS, the City Council is vested with the authority to enact measures that would regulate the use of road, alley and street within the city.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:

SECTION 1. TITLE – This Ordinance shall be known as "AN ORDINANCE CONVERTING 1st STREET, CASTILLA STREET AND VALENCIA STREET INCLUDING VALENCIA LOOP INTO ONE-WAY STREET;

SECTION 2. COVERAGE – The following streets in Barangay Valencia are to be considered one-way traffic for all private and public utility vehicles:
1st Street, Castilla Street and Valencia Street including loop into one (1) way streets;
SECTION 3. IMPLEMENTATION - This Ordinance shall be enforced and implemented by the Department of Public Order and Safety (DPOS) and by concerned Barangay Public Security Officer (BPSO) of Barangay Valencia:

SECTION 4. SIGNAGE INSTALLATION – The Department of Public Order and Safety (DPOS) together with Barangay Valencia, are hereby mandated to install and place in an unobstructed location, the necessary traffic signage for the clear view and information of motorist, and the general public of the regulated streets indicated herein;

SECTION 5. PENALTIES – Any person found in violation of this ordinance shall be penalized with a fine of not less than Five Hundred Pesos (Php500.00) but not more than Two Thousand Pesos (Php2,000.00);

SECTION 6. REPEALING CLAUSE – All Ordinances, Local Executive Orders, Rules and Regulations or any part thereof which are Inconsistent herewith are hereby deemed repealed, modified, or amended accordingly;

SECTION 7. SEPARABILITY CLAUSE – In case any provision of this Ordinance is declared unconstitutional or invalid, the other provisions hereof which are not affected thereby, shall continue to be in full force and effect;

SECTION 8. EFFECTIVITY CLAUSE – This Ordinance shall take effect upon its approval.
