** Excerpts from the minutes of the 88th Regular Session of the 6th City Council of Valenzuela held on August 33, 2015 at 2:49 P.M. at the City Council's Session Hall, 3rd Floor, Legislative Building, Valenzuela City Hall, Karuhatan, Valenzuela City, Metro Manila.

AN ORDINANCE MANDATING INDUSTRIAL, COMMERCIAL, BUSINESS AND OTHER PUBLIC ESTABLISHMENTS TO INSTALL "CCTV MONITORING SYSTEM" WITHIN THEIR PREMISES, AMENDING ORDINANCE NO. 53, SERIES OF 2009 AND FOR THE PURPOSE.

WHEREAS, the use of "CCTV Monitoring System" have proven to be of utmost importance in assisting peace keeping and investigate agencies of the government both in the areas of preventing and solving crimes being committed in the city;

WHEREAS, "CCTV Monitoring System" are now easily available for everyone and the coast of their procurement and installation are now within the capabilities of most establishments;

WHEREAS, maintaining peace and order which includes the safety of every citizen in our city is one of the most primordial responsibilities of any government;

NOW, THEREFORE, be it ORDAINED as it is hereby ORDAINED, by the Sangguniang Panglungsod of Valenzuela in formal session assembled that the following amendments to Ordinance No. 53, Series of 2009 be incorporated and duly adopted into law.

1.) SECTION 5. POLICY/APPLICATION
  1. All industrial, commercial, business, institutional, educational, business and all other public establishments operating within the territorial jurisdiction of Valenzuela with a total capital asset (case and real properties) amounting to PhP500,000.00 are required to install an operational CCTV monitoring system to serve both as a preventive and investigate counter measure.

  2. against crimes to be committed within the immediate vicinity of their premises.

  3. The CCTV monitoring systems to be installed by all establishment concerned must be able to properly capture recordings within the premises of the establishment, including the immediate vicinity of the establishment.  Twenty days after the approval of this ordinance, the Valenzuela City Command and Coordinating Center will submit the implementing guidelines pertaining to the proper installation of CCTV monitoring systems of every establishment which shall be adopted as part and parcel of this ordinance.  The proper installation and capability of the CCTV monitoring system will be subject to the inspection and approval by the inspectors of any the following agencies:

    1. The BPLO;
    2. The Valenzuela City Command and Coordinating Center
    3. and The Task Force Disiplina.

  4. The CCTV monitoring systems must be operational 24 hours on a daily basis with the recording maintained for 7 days thereafter which they may be transferred into an appropriate back up media device (CD or DVD) before being erased to make room for continued recording.  The media devices must be duly labeled with the dates of its duration before being stored in a safe place.  Upon the occurrence of any criminal activity within the immediate vicinity of any public establishment, these recordings upon formal request must be made available immediately to any law enforcement agencies of the government concerned including the Punong Barangay, failure to do so will warrant administrative penalties in accordance with the provisions of this ordinance.  However, if the operator of the establishment so perceives that there are no criminal activities recorded in their transferred and stored media devices, and no formal requests for them have been made by any of the aforementioned agencies, they may dispose of their stored records after a period of 30 days, according to their own discretion.

  5. The installation of CCTV monitoring systems will be included into the requirements for procuring the appropriate Business Licenses with the city government.  The list of establishments with installed.

    CCTV monitoring systems will be maintained by the Business Permits & Licensing Office of the city government and duly updated every four months a copy of which must be submitted to the Peace and Order Council and the Valenzuela PNP.

  6. All concerned public establishments may procure their CCTV monitoring systems from any legal source and have it installed by any legal personage.
2.) SECTION 6. PENALTIES AND DISCOUNTS.
  1. Upon effetivity of this ordinance all public establishments concerned who fail to establish the proper CCTV monitoring systems within their premises shall be penalized in accordance with the following:

    1. A notice of violation to be issued by any of the inspection authorities delineated in Section 5, b, of this ordinance with the accompanying administrative fee of PhP500.00 payable upon the renewal of the establishment's renewal of Business License for the first offense.

    2. For the second offense, suspension of the establishment's Business License warranting immediate operational closure for 100 working days and an accompanying fee of PhP1,000.00 payable before the lifting of the establishment's suspension.  Failure to pay this penalty shall warrant the continued closure of the said establishment concerned.

    3. On the third offense, suspension of the establishment's Business License warranting immediate operational closure for 100 working days and an accompanying fee of PhP5,000.00 payable before the lifting of the establishment's suspension.  Failure to pay this penalty shall warrant the continued closure of the said establishment concerned.

  2. Any establishment with an operational CCTV monitoring system in accordance with the records of the Business Permits & Licensing Office of the City Government who fails to provide the copy of the recordings of events within their premises or within their immediate vicinity of their premises when a crime was committed within the area concerned will be penalized by a suspension of their Business License warranting immediate closure for 100 working days with an accompanying penalty of PhP3,000.00 payable before the lifting of the establishment's suspension.  Failure to pay this penalty shall warrant the continued closure of the said establishment.

  3. Depending upon the discretion of the City Mayor, any public establishment whose cooperation by way of providing the copy of their records of their CCTV monitoring systems would be certified by the Valenzuela PNP as pivotal to the resolution of any crime committed within their premise or within their immediate vicinity will be given a discount of 10% up to 20% of their total Business Licenses fees to be credited on the followed fiscal year.
3.) EFFECTIVITY. These amendments shall be effective 30 days upon its approval after its publication on any media of general circulation.
