AN ORDINANCE AMENDING ORDINANCE NO. 014, SERIES OF 2004 ENTITLED, "AN ORDINANCE IMPOSING A NON-REFUNDABLE TENDER DOCUMENTS FEES FROM ALL BIDDERS OF CITY INFRASTRUCTURE PROJECTS, SUPPLIES AND MATERIALS AND THE LIKE," AS AMENDED BY ORDINANCE NO. 41, SERIES OF 2009.

WHEREAS, Section 458 (a)(3)(i) of the Local Government Code of 1991 empowers the Sangguniang Panlungsod, as the legislative body of the city, to "Fix and impose reasonable fees and charges for all services rendered by the city government to private persons or entities;"
WHEREAS, Ordinance Number 041, Series of 2009 provides that a fee of FIVE HUNDRED PESOS (P 500.00) will be charged to all suppliers and contractors for registration in order to participate in the bidding procurement of goods/services and infrastructure projects in the City Government of Valenzuela;
WHEREAS, to defray the increasing cost of materials and supplies in the preparation of documents and plans for the different projects of the City Government, it is necessary to correspondingly increase the registration fees collected from suppliers and contractors of the City Government;
WHEREAS, the City's Bids and Awards Committee (BAC) recommended an increase in the initial annual registration fees of suppliers and contractors from FIVE HUNDRED PESOS (P 500.00) to THREE THOUSAND PESOS (P3,000.00) for suppliers/contractors of goods and consulting services and FIVE THOUSAND PESOS (P 5,000.00) for contractors of infrastructure projects. Further, in the event a bidder requests for replacement for lost bid documents, the BAC likewise proposed a bid document replacement fee of FIVE HUNDRED PESOS (P 500.00) for each bid document;
WHEREAS, with the issuance of Government Procurement Policy Board (GPPB) Resolution 04-2012, dated 24 February 2012 entitled, "Guidelines on the Sale of Bidding Documents" prescribing standard rates for the sale of bidding documents, the previous Tender Documents Fees and eligibility documents fees imposed under Ordinance No. 014, Series of 2004 as amended by Ordinance No. 41, Series of 2009, are deemed repealed. The said standard rates under GPPB Resolution 04-2012 have been adopted and are presently being implemented in the City of Valenzuela.
NOW, THEREFORE, BE IT ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Valenzuela, Metro Manila, in session duly assembled that:
Section 1. Section 2 of Ordinance No. 14, Series of 2004 as amended by Ordinance No. 41, Series of 2009 is hereby amended to read as follows:
"SECTION 2. SCOPE OF APPLICATION – There is hereby imposed a Non-Refundable Tender Documents Fees from all bidders in the procurement of City infrastructure projects, goods, supplies, materials and the like, Registration Fees of Suppliers/Contractors in said projects and Document Replacement Fees to be collected by the City Treasurer's Office as follows:
1.) ANNUAL REGISTRATION FEES OF SUPPLIERS/CONTRACTORS:Section 2. REPEALING CLAUSE. All previous Ordinances and rules/regulations inconsistent with the provisions hereof are deemed repealed or modified accordingly.
Goods / Consulting Services P3,000.00 Infrastructure P5,000.00
2.) DOCUMENT REPLACEMENT FEE:
Document Replacement fee....P500.00/document
3.) NON-REFUNDABLE TENDER DOCUMENTS FEE:
The maximum rates for the sale of bidding documents as allowed under GPPB Resolution 04-2012 dated 24 February 2012 are hereby imposed, to wit:

Section 3. IMPLEMENTING RULES. The Office of the City Mayor is hereby charged and directed to carry out the provisions of this Ordinance efficiently and effectively.
Section 4. EFFECTIVITY CLAUSE. This Ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
