*** Excerpts from the minutes of the 101th Regular Session of the 6th City Council of Valenzuela held on November 23, 2015 at 3:03 P.M. at the City Council's Session Hall, 3rd Floor, Legislative Building Valenzuela City Hall, Karuhatan, Valenzuela City.
AN ORDINANCE CREATING ADDITIONAL POSITIONS OF SIX (6) ATTORNEY IV IN THE CITY LEGAL OFFICE IN VALENZUELA CITY AND PROVIDING FUNDS THEREFOR.

WHEREAS, the Local Government Code of 1991 provides that every local government unit shall design and implement its own organizational structure and staffing pattern taking into consideration its service requirements and financial capability, subject to the minimum standards and guidelines prescribed by the Civil Service Commission;
WHEREAS, the progress and development of the City brought about increase in dealings and transactions, hence it is necessary to employ sufficient number of lawyers to provide competent legal support and assistance to the City Government of Valenzuela for better public service;
WHEREAS, the current organizational structure of the City Legal Office provides for only four (4) permanent lawyers, including the Department and Assistant Department Head positions, is already outdated and needs enhancement as it restricts the City to employ lawyers in contractual arrangement only which is counter-productive in attracting good lawyers.
NOW, THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Valenzuela, in session duly assembled, that:
SECTION 1. CREATION OF PLANTILLA POSITIONS WITH ITS CORRESPONDING APPROPRIATIONS. – The following plantilla positions are hereby created in the City Legal Office of the City Government of Valenzuela with corresponding appropriation, to wit:

SECTION 2. QUALIFICATIONS. – The newly created plantilla positions shall have the following qualifications as embodied in the approved Index Occupational Services of the Department of Budget and Management (DBM) and Qualification Standard of the Civil Service Commission (CSC).

SECTION 3. TRANSITORY CLAUSE. For purpose of expediency and economy, appointment to the newly created positions or items shall be made by hiring qualified lawyer of competence and integrity and may be drawn from existing city personnel of any department or section, who may be upgraded upon recommendation of the Employees Welfare and Promotions Board (EWPB) or by the Personnel Selection Board (PSB) and approval by the City Mayor.
SECTION 4. REPEALING CLAUSE. Any City Ordinance contrary to or inconsistent with any of the provisions of this Ordinance is hereby repealed and/or modified accordingly.
SECTION 5. SEPARABILITY. If any provision of this Ordinance be declared unconstitutional or illegal by the courts, the provisions not affected by such declaration shall remain to be in full force and effect.
SECTION 6. EFFECTIVITY. This Ordinance shall take effect Fifteen (15) days from its publication.
