***Excerpts from the minutes of the 7th Regular Session of the 7th City Council of Valenzuela held on August 15, 2016 at 3:11 P.M. at the City Council's Session Hall, 3rd Floor, Legislative Building, Valenzuela City Hall, Karuhatan, Valenzuela City, Metropolitan Manila.

AN ORDINANCE INSTITUTIONALIZING THE ALTERNATIVE LEARNING SYSTEM (ALS) IN ALL BARANGAYS WITHIN VALENZUELA CITY, PROVIDING GUIDELINES AND FUNDS THEREFOR AND FOR OTHER PURPOSES.

WHEREAS, Section 17, Article II of the Philippine Constitution gives priority to education, science and technology, arts, culture, and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development;

WHEREAS, Section 2, Article XIV, of the 1987 Philippine Constitution mandates that the State shall encourage non-formal, informal and indigenous learning systems, as well as self-learning, independent, and out-of-school study programs particularly those that respond to community needs;

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that within their respective territorial jurisdictions, local government units shall ensure and support, among other things, the preservation and enrichment of culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants;

WHEREAS, Section 391, Subsection 12 (j) of the same law provides for the establishment of non formal education center in the barangay whenever feasible, in coordination with the Department of Education (DepEd);

WHEREAS, Republic Act No. 9155, otherwise known as Governance of Basic Education Acts of 2001, promulgates the Alternative Learning System (ALS) as the parallel learning system to provide viable, flexible, and accessible learning opportunities to all out-of-school youth and adults in all barangay across the country;

WHEREAS, the Department of Education, through its Bureau of Curriculum is currently facilitating the implementation of an alternative learning system in the community level pursuant to various executive issuances and department circulars;

WHEREAS, the organized implementation of an alternative learning system on the local level, through the initiative and leadership of the barangay unit, and the private sector, will contribute greatly to the provision of education for individuals who, because of their socio-economic circumstances, had been deprived of such rights.

NOW, THEREFORE, be it ORDAINED by the City Council of Valenzuela City in regular session assembled:

SECTION 1. TITLE – This ordinance shall be known as "As Ordinance Institutionalizing the Alternative Learning System (ALS) in the Valenzuela City."

SECTION 2. DECLARATION OF POLICY – It shall be the policy of the City of Valenzuela to seek organized means and systematic methods of institutionalizing the Alternative Learning System (ALS) into the regular operations of the City and its barangays in order to more expediently and effectively provide education to a larger portion of the citizenry.  It is further the policy of the Local Government to seek the greater involvement of the private sector in Alternative Learning System (ALS) endeavors.

SECTION 3. DUTIES AND FUNCTION – Each barangay is hereby authorized to perform the following:
  1. Implement the Alternative Learning System (ALS) program for out-of-school youth (OSY) and adult-age learners at the barangay level;

  2. Initiate and/or Pursue the mapping of the OSY as outlined in DILG Memorandum Circular No. 2013-18, dated March 4, 2013 and Deped Order No. 17, S. 2014.


SECTION 4. LOCATION – The (Alternative Learning System) ALS program shall be in an existing barangay structure, whether this is owned by the barangay government, such as the barangay multi-purpose hall, by the Valenzuela City Government, such as a high school in the barangay, or by a private entity within the jurisdiction of the said barangay.

The facility is enjoined to devote at least 4 days of every week for purpose of conducting the (Alternative Learning System) ALS program of the barangay level.

Whenever possible, a new structure may be established for purposes of this Ordinance.

SECTION 5. STRUCTURE – The Alternative Learning System (ALS) program shall be implemented by the following:
Unit Designation Function
Barangay ALS Coordinator Punong Barangay Coordinate with the Division of City School Division supervisor and other government and non-government institutions in fulfillment of the ALS program
Administrative Officer Barangay Kagawad Chairperson of the Committee on Education Be responsible for the day to day operation of the ALS program and the maintenance of the structures, equipment, properties and supplies and materials used in the implementation of the ALS.
Instructional Manager/s ALS Mobile Teacher Be in charge of the implementation of the ALS Curriculum as well as other literacy program such as, but not limited to, livelihood and skills training program for out of school youth and adults.
Other personnel may be designated by the City Mayor and/or lawful authority from the barangay to aid in the conduct of the Alternative Learning System (ALS) program.

The Instructional Manager (IM) must be qualified to instruct and manage the Alternative Learning System (ALS) Curriculum as determined by the Division of City Schools.  The latter may also coordinate with the Department of Education (DepEd), the Technical Education and Skills Development Authority (TESDA), and/or any University/College to ensure the constant supply of Volunteer Teachers.

SECTION 6. ADMINISTRATIVE AND CURRICULAR SUPERVISION – The Division of City Schools, through the Division Supervisor, shall have administrative supervision over the persons implementing the Alternative Learning System (ALS) program.  The Barangay Alternative Learning System (ALS) Coordinator shall closely coordinate and consult all matters related to the program with the Division of City Schools, through the Division Supervisor.

The Division of City School shall also have curricular supervision on all Alternative Learning System (ALS) programs/project that are implemented in each barangay.  It may also recommend to the Barangay Alternative System (ALS) Coordinator the Instructional Manager/s who will handle the Alternative Learning System (ALS) Program in each barangay.

In the regard, all Instructional Managers must register with the Division of City Schools according to the guidelines of the latter regarding the ALS program.

SECTION 7. IMPLEMENTING RULES AND REGULATIONS – The Division of City Schools is hereby authorized to issue the implementing rules and regulations, not otherwise in contravention with the provisions hereof, and guided by the principle of efficiency and expediency in conducting Alternative Learning System (ALS) at the barangay level under this ordinance.

The Division of City Schools, in partnership with the City Mayor is additionally authorized to conduct inspection of the barangay unit to ensure that:
  1. The Structure mandated by this ordinance have been created and are functioning;

  2. An adequate facility is reserved and devoted for the period indicated in this ordinance.
SECTION 8. FUNDING AND OPERATIONAL EXPENDITURES – Operational expenses of the Alternative Learning System (ALS) program shall include:
  1. Allocation of learning modules and other supplementary learning materials;

  2. Maintenance and other operating expenses such as training of the Instructional Manager/s, utilities expenses, and repair and maintenance of the facility being used;

  3. Instructional Manager/s honorarium, teaching and transportation expenses.
Each barangay is likewise urged to allocate the necessary funds in their annual budget for the operation and maintenance of the Alternative Learning System (ALS) program in their territorial jurisdiction.

SECTION 9. APPROPRIATION – The appropriate fund necessary to achieve the purpose of this ordinance, as recommended by the Division of City Schools, shall be made available.

SECTION 10. MISCELLANEOUS PROVISION – The Barangay Alternative Learning System (ALS) Coordinator, through the City Social Development Office and/or Liga ng mga Barangay, shall submit progress report as may be required by the Office of the City Mayor or the Division of City Schools.

SECTION 11. SEPARABILITY CLAUSE – If any part or section of this ordinance is declared unconstitutional for any reason whatsoever, such declaration shall not in any way affect the other parts or section of this ordinance.

SECTION 12. REPEALING CLAUSE – All ordinances, resolutions, resolutions, executive order, rules, regulations, and other administrative issuances, or the provisions thereof, which are contrary to or in consistent herewith are hereby repealed or modified accordingly.

SECTION 13. EFFECTIVITY – This Ordinance shall take effect within fifteen (15) days following its publication in any newspaper of general circulation.
