[ PRC BOARD OF NUTRITION AND DIETETICS RESOLUTION NO. 01, September 24, 1991 ]

REPEAL OF PROVISION ON REFRESHER COURSE IN BOARD RESOLUTION NO. 46 s. 1985



WHEREAS the Board, pursuant to Sec. 20 of P.D. No. 1286: the “Nutrition and Dietetics Decree of 1977”, issued on May 23, 1985 Res. No. 46 (Series of 1985), reducing the Nutrition and Dietetics Licensure Examination’s prescribed five (5) subjects to three (3) with their relative weights;

WHEREAS in addition to the amendment of the subjects, the said Resolution provided that: "x x x A candidate who fails to pass in two (2) examinations shall not be allowed to take another examination unless she/he undergoes a refresher course of one (1) year”;

WHEREAS neither Section 20 (Scope of Examination) and Section 21 (Ratings in the Examinations), nor any other provisions of P.D. No. 1286, do require such refresher course;

WHEREAS since the Board is bereft of the power to modify, add to, expand or repeal any provision in P.D. No. 1286 or cannot go beyond the terms and provisions thereof, the provision on refresher course in Res. 46 is nugatory; and

WHEREAS albeit the value of a refresher course in updating an examinee with the latest trends on the profession and in enhancing his/her chances to pass the examination, it behooves the Board to rectify the error thereof,

NOW THEREFORE, be it resolved, as it is hereby resolved, to repeal the herein provision in Res. No. 46 (Series of 1985), to wit:

"x x x A candidate who fails to pass in two (2) examinations shall not be allowed to take another examination unless she/he undergoes a refresher course of one (1) year."

and, accordingly, to direct the non-imposition of such requirement for the July 1992 and subsequent Nutrition and Dietetics Licensure Examination and the purging thereof in the Report of Rating.

BE IT FURTHER RESOLVED that this Resolution shall take effect upon approval of the Commission and after fifteen (15) days following the completion of the publication thereof in the Official Gazette or in a newspaper of general circulation.
