[ POEA MEMORANDUM CIRCULAR NO. 50, September 20, 1991 ]

BALIK-MANGGAGAWA PROCESSING



Pursuant to Book III, Rule II, Sections 6 & 7 of the 1991 Rules and Regulations Governing Overseas Employment, the following guidelines and revised procedures on the aforecited subject are hereby issued for the information and guidance of all concerned.

1. Filipino contract workers except seafarers, who are on vacation or on emergency leave and who are returning to the same worksite, to resume their employment within six (6) months from the date of arrival in the Philippines shall be processed individually or through the agency which previously deployed them.

For individual balik-manggagawa, the following documents shall be required:

  1. Valid passport;

  2. Valid re-entry visa, work permit or any equivalent document;

For agency-endorsed balik-manggagawa, the following documents shall be required:

  1. Previously POEA processed employment and travel documents of the contract workers;

  2. Valid passport;

  3. Valid re-entry visa, work permit or any equivalent document.

This provision supersedes the previous provision on the processing for workers on vacation within three (3) months from the date of arrival in the Philippines.

2. All recruitment agencies handling returning workers to their accredited principals shall assume responsibility over said workers for the duration of the employment contract in force. While the agencies may charge service fees to their employers for this purpose, no redeployment fees shall be collected from the returning worker.

This order takes effect immediately.
