RECALL OF MEMORANDUM DATED 27 JUNE 2013

On 26 December 2014, the undersigned received a copy of a letter dated 29 November 2013 from Office of the Secretary General stating that:

“Republic Act 10586 expressly repealed the requirement of drug testing for applicants of the driver's license imposed under Sec. 36 (a) of R.A. No. 9165. Further, that since there is no judicial order declaring the R.A. 10586 void, the Anti-Drunk and Drugged Driving Act of 2013 enjoys the presumption of constitutionality. Thus, there is presently no law requiring drug testing before a driver's license can be issued or renewed.”

A copy of the letter is attached herewith as Annex “A”*.

In view thereof, the Memorandum dated 27 June 2013 on the mandatory drug testing for issuance of driver's license is hereby recalled, there being no need for the same as the repeal is expressly provided by law.
