REDEPLOYMENT OF RETURNING FILIPINO WORKERS TO YEMEN, SUBJECT TO PROOF OF EXISTING EMPLOYMENT AS DETERMINED BY THE POEA

WHEREAS, Republic Act No. 10022 authorizes the POEA Governing Board, after consultation with the Department of Foreign Affairs (DFA), to impose a ban on the deployment of Filipino migrant workers in pursuit of national interest or when public welfare so requires;

WHEREAS, POEA Governing Board Resolution No. 02, Series of 2013 dated 27 February 2013 was issued effectively allowing the processing and deployment of all OFWs, both returning and new hires, to Yemen on the basis of a communication dated 29 January 2013 from the DFA informing the DOLE that it is lowering the Alert Level in Yemen from Alert level 2 to Alert Level 1 in the light of the current security situation in the said country;

WHEREAS, in a communication dated 09 December 2013, the DFA informed the DOLE that it has again raised the alert level in Yemen to Alert Level 3 due to the escalation of domestic violence in the country in the aftermath of the 05 December 2013 attack on the Yemeni Ministry of Defense that killed fifty-two (52) people, which included seven (7) Filipinos and leaving eleven (11) Filipino workers injured in the said attack;

WHEREAS, on 10 December 2013, GBR No. 12, Series of 2013 was issued re-imposing a total deployment ban on the processing and deployment of all OFWs to Yemen, both returning and newly-hired;

WHEREAS, in view of a general improvement of the political situation and environment following the signing of the southern Yemen solution document as well as a truce in northern Yemen between the Houthis and Salafis, the DFA recommended on 01 February 2014 the lowering of the Crisis Alert Level to Alert Level 2 (Restriction Phase);

WHEREAS, under Alert Level 2, processing and deployment of workers shall be allowed only for OFWs returning to their current employers and are with existing employment contracts;

NOW THEREFORE, the POEA Governing Board, as duly convened, RESOLVES AS IT IS HEREBY RESOLVED, to allow the redeployment of returning Filipino workers to Yemen, subject to proof of existing employment as determined by POEA. Deployment ban for newly-hired OFWs shall be maintained until further advice.
