RESOLUTION APPROVING THE AMENDMENTS IN THE TRUCK BAN FINES

WHEREAS, MMC Ordinance No. 78-04 known as the Truck Ban was amended by MMA Ordinance No. 5 Series of 1994, which was further amended by Metro Manila Council-Special Traffic Committee (MMC-STC) Resolution No. 01, Series of 2012 “Implementing a Modified Uniform Truck Ban Regulation in Metro Manila” which provide that truck ban hours shall be from 6:00 am to 10:00 am and from 5:00 pm to 10:00 pm every day except Sundays and Holidays;

WHEREAS, there are currently 79,850 trucks and 13,615 trailers plying the roads of Metro Manila on a daily basis;

WHEREAS, despite the truck ban regulations a number of trucks are being apprehended violating the truck ban rules and simply pays the current MMDA truck ban fine of Five Hundred Pesos;

WHEREAS, there is a need to amend the current truck ban fine in order to serve as a deterrent in violating the truck ban rules;

WHEREAS, the Metro Manila Council in its desire to further reduce the violators of truck ban and minimize traffic congestion, agreed to amend MMC Ordinance No. 5, Series of 1994;

NOW, THEREFORE, pursuant to Section 6 of RA 7924, Sec. 3 of MMA Ordinance No. 5 Series of 1994 is hereby amended to read as follows:

“Section 3. Any person who violates the provisions of the Truck Ban Ordinance, as amended, shall pay the fine of Two Thousand Pesos (Php2,000.00) and the driver’s license of the driver who shall be apprehended three (3) times for violation of the Truck Ban Ordinance shall be recommended by MMDA for suspension of one (1) year.

This Resolution shall take effect within fifteen (15) days from publication in two (2) newspapers of general circulation in Metro Manila and submission to the Office of the National Administrative Register (ONAR), UP Law Center.

Approved this 8th day of July 2014 at Makati City, Metro Manila Philippines.
