ACTS OF MISINTERPRETATION BY FOREIGNERS IN OTHER GOVERNMENT AGENCIES

WHEREAS, other government agencies have been transmitting reports and information to the Bureau of Immigration of foreigner’s acts of misinterpretation in their applications such as Alien Employment Permits and Driver’s Licenses;

WHEREAS, there is a need to clarify whether Commonwealth Act No. 613, Section 37 (a)(9) in relation to Section 45(f), applies to acts of misinterpretations committed in other government agencies;

WHEREAS, Commonwealth Act. No. 613, Section 37(a)(9) in relation to Section 45(f) covers foreigners who, in any immigration matter, shall knowingly make under oath any false statement or representation;

WHEREFORE, pursuant to Section 3 of Commonwealth Act No. 613, as amended, the following is hereby ordered:

Section 1. Applicability. – Commonwealth Act No. 613, Section 37(a)(9) in relation to Section 45(f) shall only apply to false statements or representations knowingly made under oath by foreigners in any immigration matter and shall not cover acts of misinterpretations by foreigners in other government agencies.

Section 2. Disposition. – All reports and information received by the Bureau of Immigration from other governing agencies concerning acts of misinterpretation by foreigners in their respective offices shall be endorsed to the Intelligence Division for verification and investigation of probable violation/s of immigration and citizenship laws, rules and regulations by such foreigners.

Section 3. Monitoring and Database. – For purposes of proper monitoring and cross-referencing, the Intelligence Division shall maintain a database of said reports and information.

Section 4. Repealing Clause. – All rules, procedures, guidelines and previous issuances inconsistent herewith are hereby repealed and/or modified accordingly.

Section 5. Effectivity. – This Order shall take effect immediately upon approval.

Furnish a copy of this Circular to the National Administrative Register (ONAR), U.P. Law Center, Diliman, Quezon City.
