NON-ACCEPTANCE OF APPLICATIONS FOR TH SERVICES WITH UNITS MORE THAN FIFTEEN YEARS OLD PURSUANT TO DEPARTMENT ORDER NO. 2017-009

In conformity with Department Order (DO) No. 2017-009, Re: REITERATING DEPARTMENT  ORDER  NO.  2002-030  AND  STRENGTHENING  THE MANDATORY  AGE LIMIT FOR BUS TYPE UNIT AND TRUCKS SUBJECT OF OR COVERED  BY CERTIFICATE  OF PUBLIC CONVENIENCE  (CPC), filing of new Applications  for Issuance  of Certificate  of Public  Convenience  to Operate Truck-for-Hire  Services  with proposed  units  to be authorized  which  are fifteen (15) years old (reckoned from the date of manufacture)  and above, shall not be accepted. Further, imported used truck as defined under the Executive Order No. 156 series of 2002 shall not be granted a CPC.

Units, which are not brand new but below the fifteen (15) year age limit shall be accepted, but can only be authorized corresponding  to the year model of the unit/ s and only until the said maximum age limit for trucks.

For existing CPCs and pending applications for Truck-for-Hire Service, there shall be a Two and one-half (2!)  years transition period or until 30 June 2020 within  which,  operators  of Truck-for-Hire  Service  will be required  to substitute their non-compliant units per DO No. 2017-009.
 
However,   upon  the  establishment   of  Motor  Vehicle   Inspection   System (MVIS) Centers during the transition period, the Roadworthiness  Certificate shall be the basis to determine a Public Utility Vehicle’s roadworthiness.

All  other   issuances   or  parts   thereof   inconsistent   herewith   are  hereby modified, amended or superseded accordingly.

This   Memorandum   Circular   shall   take   effect   immediately   following   its publication in a newspaper of general circulation and the filing of three (3) copies hereof with the UP Law Center pursuant  to Presidential  Memorandum  Circular No. 11, dated 09 October 1992.
