ESTABLISHING THE HIGH OCCUPANCY VEHICLE LANES IN EDSA

WHEREAS, the Metropolitan Manila Development Authority (MMDA), under Republic Act No. 7924 and its Implementing Rules and Regulations, is mandated to provide transport and traffic management services in the metropolis;

WHEREAS,  in  order  to  maximize  the  number  of  passengers  that  may  be conveyed through EDSA, there is a need to establish High Occupancy Vehicle (HOV) Lanes thereat;

NOW,  THEREFORE, 
be  it  resolved,  as  it  is  hereby  resolved,  that  the  Metro Manila Council declares, thus:

1.     HOV  Lanes  are  established  in  EDSA  northbound  and  southbound  and identified  as the innermost  lanes,  i.e., the lanes  closest  to the Metro  Rail Transit Line 3.

2.     A HOV is defined as a public motor vehicle, with the exception  of a public utility bus and public utility jeepney, and a private motor vehicle, with the exception of a private bus, tricycle, and motorcycle, with at least two (2) occupants including the driver, i.e., driver and at least one (1) passenger.

3.     Only HOVs may use the HOV Lanes. The applicable fines and penalties for “Disregarding Traffic Sign” and “Reckless Driving” shall be imposed upon the driver or registered owner of a non-HOV who will use the HOV Lanes.

4.     A  public  information   campaign   and  dry  run  shall  commence   from  11 December 2017 until 17 December 2017.

5.     The full implementation  of this Resolution shall start on 18 December 2017 after  it  shall  have  been  published   in  two  (2)  newspapers   of  general circulation and submission of a copy thereof with the Office of the National Administrative Register, U.P. Law Center.
