ADDITIONAL CONDITIONS FOR THE TEMPORARY OPERATION OF FOREIGN-REGISTERED SHIPS WITHIN PHILIPPINE NATIONAL TERRITORY

In the interest of service and to ensure that all Foreign-registered ships that will be allowed temporary operation in Philippine territory are designed and equipped to undertake their intended purpose/operation, the following additional conditions shall be imposed:
1.    Ship shall be subjected to survey/inspection by MARINA technical personnel prior to its actual operation and subsequently prior to renewal/extension of Special Permit.
1.1 Information on the port of entry and estimated arrival date and time shall be  communicated  and  included  in  their  application  for  issuance  of Special Permit.

1.2 The applicant shall pay the corresponding processing fee in the conduct of the said survey under MARINA Circular No. 2015-05 on the Revised Schedule of Fees and Charges, and its subsequent amendment.
2.    The ship and its officers and crew shall strictly comply with the Customs, Immigration and Quarantine (CIQ) rules and regulations; and

3.    The ship’s Long Range Identification and Tracking (LRIT) equipment, as applicable, and its Automatic Identification System (AIS) equipment to be fully operational upon entry in the Philippine waters and during the entire operation within Philippine territory.
The Enforcement Service of MARINA shall constantly monitor the operation of the foreign-registered ship while operating in the national territory during the validity of the Special Permit. Failure of the ship and/or ship agent to comply with any of  the aforementioned condition shall be ground for the cancellation or revocation of the Special Permit issued without prejudice to the imposition of administrative fines and penalties after due process.

This MARINA Advisory shall take effect immediately after its publication once in a newspaper of general circulation.
