[ PRESIDENTIAL DECREE NO. 1804, January 16, 1981 ]

PROHIBITING AND PENALIZING THE GRANTING OF PERMITS FOR THE HOLDING OF PUBLIC RALLIES, DEMONSTRATIONS, ASSEMBLIES AND SIMILAR MEETINGS TO PERSONS FOUND GUILTY OF REBELLION, SEDITION OR SUBVERSION WHO HAVE NOT BEEN GRANTED AMNESTY THEREFOR, AND TO PERSONS CHARGED WITH ANY OF SAID CRIMES.

WHEREAS, it is necessary in the interest of public order and safety to regulate the exercise of the power of local officials to grant permits to hold public rallies, mass demonstrations, assemblies and similar meetings in order to ensure that the dissident elements in society are not provided with potent avenues for furthering their subversive, or seditious, or unlawful activities;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree as part of the law of the land the following:

SECTION 1. No permit to hold public rallies, mass demonstrations, assemblies and similar meetings shall be granted to persons who have been found guilty of rebellion, sedition or subversion, and who have not been granted amnesty therefore, or to persons who have pending charges for any of the aforesaid crimes.

SEC. 2. The penalty of prision correctional in its medium period to prision mayor in its minimum period shall be imposed upon the public officer or employee who violates the provision of this decree.

SEC. 3. Any provision of law, rule or regulation contrary to or in conflict with this decree shall be considered repealed or modified accordingly.

SEC. 4. This Decree shall take effect immediately.
