[ PRESIDENTIAL DECREE NO. 2014, January 23, 1986 ]

AMENDING PRESIDENTIAL DECREE NO. 1314. EXEMPTING PROJECT BENEFICIARIES OF THE TONDO FORESHORE DEVELOPMENT PROJECT WHO OWN AND HOLD ORIGINAL AND/OR TRANSFER CERTIFICATE OF TITLE TO LAND ISSUED THROUGH HE PREDECESSOR GOVERNMENT AGENCIES OF THE NATIONAL HOUSING AUTHORITY FROM PAYMENT OF THE PROJECT DEVELOPMENT COST

WHEREAS, Presidential Decree No. 1314 dated 20 March 1978 which defines the land tenure policies in the Tondo Foreshore Development Project, provides that project beneficiaries holding titles to land shall be charged a fee corresponding to the development cost of the project which is P0.95 per square meter per month;

WHEREAS, the family beneficiaries of the Tondo Project who are holding Original and/or Transfer Certificates of Titles to their land have petitioned that they not be charged the development cost fee since at the time of implementation of the Tondo Project, they had on their own, caused the 'installation of essential services such as water, electricity and sewerage and therefore did not benefit as much as those beneficiaries who did not own the land at the start of the project;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and direct:

SECTION 1. Presidential Decree No. 1314 dated 20 March 1978 specifically Section 5, is hereby amended to the effect that project beneficiaries of the Tondo Foreshore Development Project who own and hold Original Certificates of Title and/or Transfer Certificates of Title over their homelots issued through the predecessor agencies of the National Housing Authority and covering lets within Cases 1 and 7 inclusive of Subdivision Plan RL 1004 executed by the Bureau of Lands pursuant to Section 1 of RA 1597 dated 31 March 1957, shall be exempted from payment of the project development cost;

SEC. 2. Any provision of law, decree, executive order, rules and regulations inconsistent herewith are repealed, amended and modified accordingly.

SEC. 3. This Decree shall take effect immediately.

Done in the City of Manila, this 23rd day of January, in the year of Our Lord, nineteen hundred and eighty-six.
