[ PRESIDENTIAL DECREE NO. 495, June 28, 1974 ]

AMENDING SECTION 1954, PARAGRAPH (C) OF THE REVISED ADMINISTRATIVE CODE, AS AMENDED

WHEREAS, a vital operational requirement of our national population planning program is the utilization of postal facilities, particularly in the transmission of contraceptive devices;

WHEREAS, under existing postal rules and regulations, contraceptive devices are deemed unmailable; and

WHEREAS, it is felt that this postal regulation may-have adverse effect on the overall operational efforts on family planning; hence, there is a need to allow the legal utilization of the mails for transmitting all acceptable methods of contraception;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081 dated September 21, 1972, and General Order No. 1 dated September 22, 1972, do hereby further amend Section 1954, paragraph (c) of the Revised Administrative Code, as amended by Republic Act No. 4623, to read as follows:

"Sec. 1954. Absolutely nonmailable matter.—

"(a) * * *
"(b) * * *
"(c) Articles, instruments, drugs, and substances designed, intended or adapted to produce abortion, or for any indecent or immoral use, or which are advertised or described in a manner calculated to lead another to use or apply them for producing abortion, or for any indecent or immoral purpose."

This Decree shall take effect immediately.

Done in the City of Manila, this 28th. day of June, in the year of Our Lord, nineteen hundred and seventy-four.
