[ PRESIDENTIAL DECREE NO. 1042, October 25, 1976 ]

AMENDING SECTION 8 OF PRESIDENTIAL DECREE NO. 978

SECTION 1. Pending the organization of the Court of Military Appeals (COMA), and in order not to delay the disposition of cases tried by the military tribunals and courts-martial, Section 8 of Presidential Decree No. 978 is hereby amended to read as follows:

"Sec. 8. Transitory provisions. — Pending the organization of the Court of Military Appeals, all records of cases tried by the military tribunals and courts-martial which are pending appellate review on the effective date of, and are required to be reviewed by the Court of Military Appeals as provided in Presidential Decree No. 978 shall continue to be reviewed in accordance with the provision of Presidential Decree No. 39 as amended by Presidential Decree No. 566. All other records of cases shall be reviewed and acted upon as provided in Presidential Decree No. 978. After the organization of the Court of Military Appeals and the formulation of its Rules of Procedure, all records of cases shall be reviewed in accordance with Presidential Decree 978.

SECTION 2. This decree shall take effect immediately.
